Re: DEMAND LETTER

Dear Sir/Madam,

I was transferred from Slick Rock Tanning & Spa in Washington to the company’s branch in Idaho. I was then fired for gossiping. I have asked for proof of gossiping but none has been availed to me. I have received information that the company is disputing my unemployment claim. I have been informed that the reason why the company is disputing my unemployment claim is because I refused to work or that I was unavailable for work.

I would like to state that I was unavailable for work due to medical reasons. I have a weak immune system. As a result, my doctor advised me to stay away from exposure to Covid-19, which will be detrimental to my already weak immune system. My doctor advised me to work from home or reduce my working hours to reduce exposure to Covid-19. I have a letter from my doctor in this regard. There have been some activities at the company which could have exposed me to the risk of Covid-19, including the boat party in August last year. If I had engaged in those activities, I would have contracted Covid-19 which would have negatively impacted my immune system and overall health.

I strongly believe that everyone should wear masks to combat the spread of Covid-19 and enable us return to normalcy. When I worked at the Washington office, I raised concerns that people were not wearing masks as per Washington state law. From that point, I was treated differently by being assigned roles I had no training for, cutting my work hours and eventually transferring me to the Idaho office. I am under the impression that these were acts of retaliation against me for my strong belief that everyone should wear masks to help us overcome the current pandemic.

I believe I was not accorded due process prior to termination of my employment at Slick Rock Tanning & Spa, Idaho. On the day my employment was terminated, all my work emails and correspondences were deleted. I was unfairly terminated.

Even after terminating my employment, Slick Rock Tanning & Spa has gone further to dispute my unemployment claim on the basis that I refused to work or was unavailable for work, when it is clear that I could not be able to work due to the aforementioned health reasons. I hereby demand that Slick Rock Tanning & Spa withdraw their dispute of my unemployment claim within the next 14 days.

This letter will act as a final warning to withdraw your dispute of my unemployment claim. At this time, I am not contacting the authorities or filing a civil suit against you, as I hope we can resolve this matter without authoritative involvement. I am not under any circumstances, however, waiving any legal rights I have presently, or future legal remedies against you by sending you this letter.

I expect to hear back from you in a timely manner of no more than fourteen (14) days from the time of this letter. If the dispute of my unemployment claim is not withdrawn within this 14-day period, I will seek appropriate relief before a court of proper jurisdiction for full payment plus all costs, damages and witness fees.
