RE: COMPLAINT ABOUT SLICK ROCK TANNING & SPA

With great hesitation, I would like to address some additional concerns about Slick Rock Tanning & Spa, my employer. This hesitation comes with concern for my health and retaliation against me.

I was transferred from Slick Rock Tanning & Spa in Washington to the company’s branch in Idaho. I was then fired for gossiping. I have asked for proof of gossiping but none has been availed to me. I have received information that the company is disputing my unemployment claim. I have been informed that the reason why the company is disputing my unemployment claim is because I refused to work or that I was unavailable for work.

I would like to state that I did all work and was present in all the shifts I was assigned. I was able-bodied at all times and never refused to do any work. I never argued whenever work or shifts were assigned to me. I even volunteered to work at an event. My doctor became concerned that I was being exposed to Covid-19 because people at work were not wearing masks. The conditions at the workplace prevented me from being able to work 40 hours/week. There was no ventilation and I wasn’t allowed to turn on the thermostat.

I strongly believe that everyone should wear masks to combat the spread of Covid-19 and enable us return to normalcy. When I worked at the Washington office, I raised concerns that people were not wearing masks as per Washington state law. From that point, I was treated differently by being assigned roles I had no training for, cutting my work hours and eventually transferring me to the Idaho office. I am under the impression that these were acts of retaliation against me for my strong belief that everyone should wear masks to help us overcome the current pandemic. There was a Covid-19 outbreak at the Idaho office in August 2020 because of a trip that employees had attended in total disregard of Covid-19 guidelines and regulations. Exhibit 1. The management managed to sweep the story under the rug.

Despite my hard work, dedication and commitment to the company, my employment was unfairly terminated. I believe I was not accorded due process prior to termination of my employment at Slick Rock Tanning & Spa, Idaho. On the day my employment was terminated, all my work emails and correspondences were deleted.

Even after terminating my employment, Slick Rock Tanning & Spa has gone further to dispute my unemployment claim on the basis that I refused to work or was unavailable for work, when it is clear that I could not be able to work due to the aforementioned health reasons.

Keeping in view the above-mentioned circumstances, I would like Slick Rock Tanning & Spa to withdraw its dispute of my unemployment claim and refrain from disputing any unemployment claim in future. I am not in a rush to initiate civil action against Slick Rock Tanning & Spa. I am open to resolving this matter in an amicable manner. I will have no reason to sue if Slick Rock Training & Spa act accordingly. However, this should not be misconstrued as a waiver of any of my rights.
