RE: MENTAL AND EMOTIONAL ANGUISH CAUSED BY THE FORCED SALE OF MY HOUSE
Reference is made to the above-captioned matter.
I write to you concerning a forced sale of my house without my express consent. The facts of my case are that my son, Nino, presented renovations he thought worthy to my other son. The latter, being the trustee of my project saw the project worth funding and withdrew money from my account. This is despite the trust attorney being against the idea. The agreement was that upon sale of the house the money would be refunded to my account and my sons split the profit 50/50.
However, at a certain point, Nino insisted that the funds of the renovation should not be done on a trust basis anymore. At this time, they had already moved into the home and I was in rehab at hospital. My son informed me that it was impossible to complete the transaction without it going intro trust. Nimo kept pressuring me while in hospital that the deal be closed since he was desperate for the money.
Later on, my sons agreed on drafting an agreement for the deal. However, the agreement was one-sided as it only favored Nimo placing me at jeopardy. The contents of the agreement indicated a forced sale of my home. Nimo even severally served me with threats of force selling my home if I do not remove the trust. He then granted me an offer to exit and secure a reverse refi, pay off existing mortgage of 418,000 and give them an additional 100,000 to buy them out, aside from the additional 139,000 she put in to get in the house.
The preceding has not only led to disagreements between me and my son, Nimo, but has also adversely affected me mentally, emotionally, and physically (please find attached my medical records). I have been in hospital more than 3 times in the past month from stress related issues anxiety of being dispossessed. I thus seek you, being an arbitrator to lift the forced sale once I remove my second son as a trustee and add Nimo as the beneficiary. I also ask you to intervene and aid me buy the other side out since the process is already taxing on my health and overall well-being.
Your intervention on settling this dispute would be highly appreciated. I also request that you advise me on the possibility of relying on a clause in the ownership agreement to buy the rest. Your prompt assistance will be appreciated.
