WAIVER AND RELEASE OF LIABILITY AGREEMENT.
I, hereby agree to this waiver of liability, the release of all claims, and the assumption of
risk and Indemnification (“Waiver and Release”).
I acknowledge and agree that I am purchasing frozen IQF product from
______________ and I do hereby retain their services to transport the product and I
hereby allow or product to be held at 41 degrees for 5 days prior to processing and
direct the carrier and shipper to set the temperature in the refrigerated trailer at 41
degrees.
I hereby waive any claims that I may have now and, in the future, release from all
liability, and agree not to sue ________________, its officers, agents, representatives,
vendors, or employees (hereinafter referred to as “Staff”) for any injury, death, product
damage, or loss sustained by me as a result of my instructions due to any cause
whatsoever, including without limitation, negligence on the part of ______________ or
mine, or product damage as a result of war, civil unrest, refrigeration or epidemic.
I agree and accept the quality of the product will not be affected by my request to raise
the transport temperature.
I further agree that if I violate the terms of this agreement and attempt to bring a lawsuit
against the parties herein, I will be held responsible for the attorney’s fees and any
costs incurred in defending such action.
I accept all the inherent risks herein and the possibility of product damage or loss
resulting therefrom.
In entering this Waiver and Release, I am not relying on any oral, written, or visual
representations or statements by ________________, or any other inducement or
coercion.
I confirm that, by my own free will, I have read and understood the Terms and
Conditions of this Wavier and Release before signing it and agree that this Waiver and
Release is fair and will be binding upon my heirs, next of kin, executors, administrators,
and successors.
