WAIVER AND RELEASE OF LIABILITY.
I, hereby agree to this waiver of liability, the release of all claims, and the assumption of
risk (“Waiver and Release”).
I hereby waive any claims that I may have now and in the future, release from all
liability, and agree not to sue DALMAN SNOW REMOVAL, its officers, agents,
representatives, subcontractors, or employees (hereinafter referred to as “Staff”) for any
personal injury, death, property damage, or loss sustained by me as a result of the
services provided by DALMAN SNOW REMOVAL i.e., shoveling driveways and homes
for homeowners which includes clearing snow measuring 5cm or more within 24 hours
by using snowblowers and shovels, including without limitation, negligence on the part
of DALMAN SNOW REMOVAL or mine, or death or injury as a result of war, civil unrest
or epidemic.
I further agree that if I violate the terms of this agreement and attempt to bring a lawsuit
against DALMAN SNOW REMOVAL or the parties herein, I will be held responsible for
the attorney’s fees, any costs incurred in defending such action, and any damages that
might arise out of the lawsuit.
I am aware that ice and snow result in slips, falls and sliding vehicles which may cause
bodily harm and damage to property, in addition to the usual dangers and risks inherent.
I accept all the inherent risks herein and the possibility of personal injury, death, or
property damage or loss resulting therefrom.
In entering this Waiver and Release, I am not relying on any oral, written, or visual
representations or statements by DALMAN SNOW REMOVAL, or any other inducement
or coercion.
I fully accept the responsibility for my well-being, and health throughout the services
and/or activities.
I confirm that, by my own free will, I have read and understood the Terms and
Conditions of this Wavier and Release before signing it and agree that this Waiver and
Release is fair and will be binding upon my heirs, next of kin, executors, administrators,
and successors.
