WHEREAS The PhD Studios LLC (hereinafter referred to as the “landlord”) is the owner of a real estate located at _________________ (hereinafter referred to as the “studio”).

WHEREAS the undersigned (hereinafter referred to as the “tenant”) desires to use the studio.

NOW THEREFORE in consideration of the tenant is permitted to enter and use the studio on behalf of themselves, their clients, and personal representatives, hereby agree as follows; –

  1. Length of Use.

The rental periods are arranged at the time of booking. 

The length of use shall include all the necessary installments needed by the tenant. The tenant herein books the studio for _______________ from _________ to _________.

The studio must be cleaned and vacated when the tenant’s time to move out has reached.

  1. Payment.

All fees payable will be done prior to the booking via _________________ to the following Landlord banking details; –

  1. Release.

In consideration of the tenant using the studio, the tenant hereby waives, releases, and covenants not to sue the Landlord from any claim, including negligence of the Landlord, its employees, or agents, which may result in personal injury, accident, and studio loss arising from its use.  

  1. Indemnity.

The tenant discharges and holds harmless the Landlord and its employees or agents from all claims, liabilities, damages, losses, charges, or expenses in connection with or as a result of an injury or damage from the tenant being in occupation of the studio and its activities thereon.

The tenant is liable for any damage or injury sustained either directly or indirectly to themselves, assistants, employees or clients whom they have brought into the studio.

  1. Insurance.

The tenant is required before the booking to provide proof of having business insurance of a limit of $250,000 in liability during the length of usage. The insurance will be in addition to the existing liability insurance of the Landlord. The tenant’s insurance shall be deemed primary in the event of any claim or damage. 

  1. Restoration.

The tenant shall promptly restore the studio and its contents to the state it was at the time of entry/handover by the Landlord.

  1. Dispute Resolution.

In case of any conflict/dispute arising from this agreement, the matter shall be resolved by mutual negotiations and be referred to the insurance for resolution.

  1. Applicable Law.

This waiver and liability release agreement shall be governed by the laws of the State of Arizona. 

  1. Assignment.

The tenant may not assign its rights and obligations under this agreement without the prior consent of the Landlord.

  1. Severability.

Suppose any provision of this waiver and liability release agreement is found by a court of competent jurisdiction to be invalid and unenforceable. In that case, the provision shall be severed from the agreement, and the remaining provisions shall continue to apply in full force and effect without being invalidated.

  1. Understanding.

I have read and fully understood the terms provided herein, and that I am signing this agreement willingly and voluntarily. By my signing hereof, I intend to issue a complete and unconditional release of all liability to the Landlord to the greatest extent allowed by the Law.
