VIDEOGRAPHER AGREEMENT.
This Videographer Agreement (hereinafter referred to as the “Agreement”) is made and entered on this ____ day of _____ 2021 (the “Effective Date”), between Diego Hammarlund, Contact Info: Address: __________________________________________ Phone NO: ____________________________ Email: _________________________________ (hereinafter referred to as the “Videographer”), and _____________________________, Contact Info: Address: ____________________________ Phone NO: ___________________________ Email: ________________________________(hereinafter referred to as the “Client”).
NOW THEREOF, in consideration of the mutual covenants and promises made by the Parties hereto, the Parties covenant and agree as follows:
- TERM.
The initial term of this Agreement shall be for a period __________ [Hours/Days/Weeks], commencing on the Effective Date herein.
- SCOPE.
- The Client is hiring the services of the Videographer as a freelance videographer for the Client’s project. The specifications for the project include;

- The Videographer’s obligations shall include shooting-to create videos and photo content according to the Client’s instructions and specifications.
- The Client shall be obligated with providing the Videographer clear instructions for the project in writing ____ days before the actual shoot day.
- PAYMENT/COMPENSATION.
The Client shall pay the Videographer Two Hundred and Fifty Thousand Dollars ($250) for all the services. One Hundred and Fifty Dollars ($150) to be paid before or on the shoot day, and One Hundred Dollars ($100) to be paid upon the delivery of the final video to the Client.
The Client understands and acknowledges that in the event that the Videographer shall be required to provide in-person filming for the shoot, the Client shall pay an extra One Hundred Dollars ($100) per day for the shoot.
- LIABILITY/INDEMNITY.
The Videographer understands the risks involved in their line of job as covered under this Agreement. The Client shall not be held responsible for any injuries suffered by the Videographer and/or the Videographer’s teammates as they perform their obligations under this Agreement, provided the injuries are not as a result of the Client’s negligence. The Videographer and the Videographer’s teammates agree to indemnify the Client against any and all related claims.
- RELATIONSHIP BETWEEN THE PARTIES.
The Videographer shall be retained as an independent contractor. The Videographer shall be fully responsible for payment of their own income taxes on all compensation earned under this Agreement. The Client shall not withhold or pay any income tax, social security tax, or any other payroll taxes on the Videographer’s behalf during the term of this Agreement.
- WAIVER AND ASSIGNMENT.
- The waiver by either Party of any breach or failure to enforce any of the terms and conditions of this Agreement at any time shall NOT in any way affect, limit, or waive such party’s right thereafter to enforce and compel strict compliance with every term and condition of this Agreement.
- No Party shall assign its rights or obligations under this Agreement without prior Notice or consent by the other Party.
- FORCE MAJEURE:
The failure on the part of the Videographer to perform his obligation under this Agreement will not be considered as default if such failure is the result of other previously scheduled/booked projects and/or natural calamities, acts or God, Covid-19, extreme adverse disasters and circumstances beyond the control of the parties. The Videographer shall however be required to communicate such delays/inconveniences to the Client promptly so that to allow the Client to pause current contract until the Videographer is able to resume work.
- DISPUTE RESOLUTION.
In the event of disputes arising about the execution of this Agreement and/or performance of obligations stated herein, the Parties shall solve such issues through a mediation process.
- TERMINATION/CANCELLATION.
Parties agree that either Party can cancel/terminate the Agreement at any given time, provided that the intending Party provides the other Party a ________ Day Written Notice on the cancel/termination. If the Client terminates/cancels this Agreement after the shoot has taken place, they shall ensure to pay the Videographer the balance of the agreed amount.
- MODIFICATION.
This Agreement contains the entire Agreement between the Parties relating to the subject matter hereof and supersedes any and all prior agreements or understandings, written or oral, between the Parties related to the subject matter hereof. No modification of this Agreement shall be valid unless made in writing and signed by both parties hereto.
- GOVERNING LAW/JURISDICTION.
This Agreement shall be governed by and construed in accordance with the laws of _____________ [State/Country]. Exclusive jurisdiction and venue shall be in _____________ [State/Country].
Each party represents and warrants to the other that such party has acted in good faith, and agrees to continue to so act, in the negotiation, execution, delivery, performance, and any termination of this Agreement.
