VIDEO AND PHOTO PRODUCTION AGREEMENT

This Video and Photographer Production agreement is entered into by and between _______________________________ (hereinafter “the Client”) and GLASSHOUSEFILMZ & VISIONSTRAIGHTFORWARD (hereinafter “the Videographer”) as of September 4th 2021 (“the Effective Date”). Individually referred to as “Party” and collectively referred to as “Parties”.  Both Parties agree to be bound as follows: 

  1. WORK AND PAYMENT

Whereas, the Client is hiring the Glasshousefilmz to produce a 4 min vide0 for the Client and photographs of the wedding, the Glasshousefilmz promises to their skills and competence in producing the said “work product”.

Whereas, the Client has a wedding on September 4th 2021 at ____________________ which starts at 5.00pm

Whereas, the Client will like to engage Glasshousefilmz exclusively to provide photography and videography services as from 3.30 pm to 9.30 pm.

 Payment. In consideration of the services rendered by the Glasshousefilmz, the Client will reimburse the Glasshousefilmz as follows: $ 1300 for the 6hours; whereby the client will pay a deposit of $ 800 and the remaining $ 500 is due a week before the wedding. 

Payment mode. The Client will make payments via Cash App payments as and when the work product is delivered. 

  1. OWNERSHIP AND LICENSES

As part of his job, the Glasshousefilmz is creating “work product” for the Client. Glasshousefilmz hereby gives the Client this work product once the Client pays for it in full. This means that the Glasshousefilmz is giving the Client all of its rights, titles, and interests in and to work product (including intellectual property rights), and the Client will be the sole owner of it. The Client may use the work product however it wants or it can decide not to use the work product at all.

Additionally, once the Glasshousefilmz gives the work product, he can use the work product to create his website, portfolio or advertise his services on social media. The Glasshousefilmz is not allowed to sell or otherwise use the work product to make money or for any other commercial use. 

  1. TERMINATION AND CANCELLATION

Either Party may cancel this Agreement by providing sufficient notice preferably 14 day notice to the other party before the delivery of the “work product” commences. Additionally, Glasshousefilmz may terminate this Agreement if the Client defaults in payment. 

  1. INDEPENDENT CONTRACTOR

Nothing herein shall be taken to establish any partnership, joint venture, agency, or employment relationship. Glasshousefilmz is, and at all times will be, an independent contractor. Glasshousefilmz shall receive no benefits from the Client. Glasshousefilmz shall be responsible for all of Glasshousefilmz’s own taxes, and no amounts will be withheld by client.

  1. NO GUARANTEE OF POSES

If Client wishes to have certain poses or photos, Glasshousefilmz will make every effort to include such poses but does not warrant that such poses or photos will turn out in the manner the Client wishes or that such poses or photos will be usable for Client’s needs.

  1. MUTUAL COOPERATION

Both Parties agree to cooperate for the duration of the Parties’ relationship. Glasshousefilmz agrees to use discretion, skill, discretion and experience to produce the best shots possible for the Client. Further, the Client will be responsible to Glasshousefilmz for the payment of fees due, regardless of the late operation of sessions or any unforeseen circumstances which are not the fault of Glasshousefilmz.

  1. DISPUTE RESOLUTION

Any dispute arising regarding the subject matter of the agreement shall be solved by negotiation between the parties.

  1. GOVERNING LAW

This Agreement shall be governed in all respects by the laws of the state of Florida and any applicable federal law. Both Parties consent to jurisdiction under the state and federal courts within the state of Florida. The Parties agree that this choice of law, venue and jurisdiction provision is not permissive, but rather mandatory in nature.

  1. ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between the Parties and supersedes any prior or contemporaneous understandings, whether written or oral.

  1. FORCE MAJEURE

The Glasshousefilmz will not be liable for any failure to perform due to causes beyond its reasonable control including, but not limited to, acts of God, acts of civil authorities, riots, embargoes, acts of nature and natural disasters, and other acts which may be due to unforeseen circumstances.
