By using our services, in our website www.fallpreventionfoundation.org , you agree to be legally bound between you and the “Company”, “we”, “us”, and “our”. If you do not accept and agree to be bound by all of the terms and conditions of this Agreement, please do not use our service.
USE
You shall use our services for the created purpose which is to rent the products from the Company for your use.
ELIGIBILITY
You are not authorized to create an account or access the services provided by us unless you are at least 18 years of age and above.
REGISTRATION
You will have to sign up, including your user’s name, email address, and personalized password. Once you have created your profile, you will have access to the available rental options.
PAYMENT
All the complete rental payment is in accordance with the rental agreement in our website.
RETURN
The products should be returned in good working order and in the event the product is returned damaged or missing pieces, you will be charged for the cost of the repair.
In the event the product is not returned as agreed, you will pay $350 for each unreturned Independence Pole and $800 for each unreturned Independence Rail.
INDEMNIFICATION
By using these services offered by us, you agree to hold harmless and indemnify the company from any claims, damages, liability, injury, or third-party claims arising from your use of our services in terms of any misuse of the products, breach of the terms of these terms or any violation of any law.
GOVERNING LAW
These terms of use shall be governed by the laws of New Mexico.
MODIFICATION
We reserve the right to modify or change these terms from time to time for any reason at our discretion without notice.
We shall notify you of any changes to these Terms by any reasonable means, including but without limitation to posting the revised version of the Terms.
You should, therefore, periodically visit the website page to review the most current terms.
ASSIGNMENT
We will not assign our rights and obligations under these terms to any third parties without your authorization.
