In consideration of the services provided by the Company, I hereby acknowledge and agree to the following:

1.ASSUMPTION OF RISK:

I understand and acknowledge that appliance repair work may involve certain risks, including but not limited to property damage, injury, or other unforeseen consequences. I voluntarily assume all such risks associated with the repair services provided by the Company.

  1. RELEASE AND WAIVER:

In consideration of the services rendered by the Company, I hereby release and discharge the Company, its owners, employees, agents, successors, and assigns from any and all claims, demands, liabilities, actions, or causes of action arising out of or related to the appliance repair services, including but not limited to claims for property damage, personal injury, or any other loss.

  1. LIMITATION OF LIABILITY:

I agree that the total liability of the Company, its owners, employees, agents, successors, and assigns, for any and all claims arising out of or related to the appliance repair services provided, shall be limited to the amount paid by me for the specific services rendered by the Company.

  1. INDEMNIFICATION:

I agree to indemnify and hold harmless the Company, its owners, employees, agents, successors, and assigns, from any and all claims, liabilities, damages, costs, or expenses (including attorney fees) arising out of or related to the appliance repair services, including but not limited to claims brought by third parties.

  1. INSURANCE:

I understand that the Company may maintain liability insurance coverage, but it does not extend coverage for any damages or losses beyond what is expressly provided for in this waiver.

  1. SEVERABILITY:

If any provision of this waiver is found to be invalid or unenforceable, the remaining provisions shall continue to be binding and enforceable to the fullest extent permitted by law.

By signing below, I acknowledge that I have read and understood this Liability Waiver and agree to be bound by its terms.

  1. WARRANTIES:

I acknowledge and understand that the Company provides repair services on an “as-is” basis, without any warranties or guarantees, whether expressed or implied, including but not limited to warranties of merchantability or fitness for a particular purpose. I agree that the Company shall not be held responsible for any dissatisfaction with the repair services provided.

  1. ACCESS TO PROPERTY:

I grant the Company and its authorized representative’s access to my property to perform the necessary repair services. I understand that it is my responsibility to ensure a safe working environment and remove any obstacles or hazards that may impede the repair process.

  1. COMPLIANCE WITH APPLIANCE MANUALS:

I acknowledge that the Company may follow the manufacturer’s guidelines and recommendations when providing repair services. I agree to provide the Company with all relevant appliance manuals, instructions, and passwords necessary for the completion of the repair services.

  1. ADDITIONAL COSTS:

I understand that the Company may identify additional repairs or parts needed during the course of the repair services. In such cases, I authorize the Company to proceed with the necessary repairs and agree to pay any additional costs associated with the repair, subject to prior notification and approval.

  1. TIMEFRAME AND DELAYS:

I acknowledge that the repair services’ timeframe is an estimate and may vary depending on various factors, including the availability of parts and the complexity of the repair. I agree that the Company shall not be held liable for any delays in the completion of the repair services.

  1. CONFIDENTIALITY:

I understand that the Company may have access to personal and confidential information related to my appliance(s) and its repair. I authorize the Company to handle such information with due care and agree that the Company shall not be held responsible for any breach of confidentiality that occurs due to factors beyond its control.

  1. DISPUTE RESOLUTION:

Any dispute arising out of or relating to this Agreement shall be resolved through mediation administered by the American Arbitration Association in accordance with its Commercial Mediation Procedures. If the dispute cannot be resolved through mediation, the parties agree to submit to the exclusive jurisdiction of the courts located in Georgia.

  1. GOVERNING LAW:

This liability waiver shall be governed by and construed in accordance with the laws of Georgia. Any disputes arising out of or related to this waiver shall be subject to the exclusive jurisdiction of the courts located in Georgia.
