This Service Agreement (hereinafter referred to as the “Agreement”) is made and entered on this ____ day of _____ 2021 (the “Effective Date”), between Select Waste Services, LLC, Contact Info: 75 La Grange, Texas 78945 (hereinafter referred to as the “Company”), and __________, Contact Info:  ___________, (herein referred to as the “Client”).

WHEREAS, the Company is septic system services, waste water transportation, construction and repair services including but not limited to plumping, cleaning and inspections to hospitals, restaurants, municipalities and homeowners.

NOW THEREOF, in consideration of the mutual covenants and promises made by the Parties hereto, the Parties covenant and agree as follows:

  1. TERM.

The initial term of this Agreement shall be for a period ______ [Days/Weeks/Months/Years] commencing on the Effective Date herein.

  • SCOPE.
    • The Company shall of the Client the following services;

☐ Septic Tank/Other repairs/Replacement.

☐Distribution Box/Leach Field Repair/Replacement.

☐Complete Septic System Installation.

☐Investigation Diagnosis of problem

☐Camera Usage

☐Diagnose/Clean out/Unclog

  • The Client shall provide all/any information and plans to the Company that they may have or know that relates to hidden underground private utilities (gas lines, septic lines, electrical lines, sprinkler lines, plumbing lines, propane tanks, etc) before any excavation begins on the said property. In the event that the Company damages any hidden items that was not disclosed to them in any way, the Company shall do their best in rearing such items so the original condition at the Client’s expense.
    • The Company shall the right to add labor/budget should they encounter unforeseen obstacles such as large stones while they are performing their obligations under this Agreement.
    • The Client shall pay the Company ___________ Dollars for the services covered under this Agreement, payment shall be 50% when the job starts and the balance 50% up on job completion. Where applicable the site evaluation cost shall be ________ Dollars.
    • All unforeseen costs such as local and federal taxes shall be paid with the balance upon completion of the service
    • Where applicable and necessary, if required under the local, State and Federal laws, the Client shall apply and obtain for all the necessary licenses and the permits.
    • In the event that the Client fails to obtain the necessary licenses and/or permits and this affects the Company’s ability to complete the service covered herein, the Company shall retain the deposit made plus make a deduction for all expenses covered by the Company.

The Company shall be retained as an independent contractor.  The Company shall be fully responsible for payment of their own income taxes on all compensation earned under this Agreement.  The Client shall not withhold or pay any income tax, social security tax, or any other payroll taxes on the Company’s behalf during the term of this Agreement.

    • The Company shall not be held responsible for any damage caused to the Client’s property if such damage was caused because the Client failed to inform the Company of the special/urgent care needed to perform the service. The Client agrees to indemnify the Company against any claims that may arise as a result of damages to the property. The Company shall only be required to pay for repair expenses if the damages were as a result of their negligence.
    • The Company and the Company’s employees acknowledge and understand the risks involved with line of work covered under this Agreement. The Client shall not, during the term of this Agreement, be held liable for any injuries sustained by the Company or any of the Company’s employees while carrying out their obligations under this Agreement, as long as the injuries are not in any way due to the Client’s negligence. The Company agrees to indemnify the Client against any claims that may arise from the performance of this Agreement.
    • The waiver by either party of any breach or failure to enforce any of the terms of this Agreement at any time shall not in any way affect, limit, or waive such Party’s right thereafter to enforce and compel strict compliance with every term and condition of this Agreement.

The failure on the part of the Company to perform their obligation under this Agreement will not be considered as default if such failure is the result of natural calamities, acts or God, Covid-19, extreme adverse disasters and circumstances beyond the control of the parties.


The Parties acknowledge that either Party can terminate/cancel this Agreement at any time provided that they issue a ___ Hour Written Notice on the same before the commencing of the project. The Client understands that if they terminate/cancel this services after the project has begun, they shall forfeit the deposit paid as well as pay for any and all expenses that has been covered by the Company.


This Agreement contains the entire Agreement between the Parties relating to the subject matter hereof and supersedes any and all prior agreements or understandings, written or oral, between the parties related to the subject matter hereof.  No modification of this Agreement shall be valid unless made in writing and signed by both parties hereto.


This Agreement shall be governed by and construed in accordance with the laws of ____________ [State/Country]. Exclusive jurisdiction and venue shall be in ____________ [State/Country].
