RENTAL CAR BROKER AGREEMENT.
This Rental Car Broker Agreement (hereinafter referred to as the “Agreement”) is made and entered on this ____ day of _____ 2021 (the “Effective Date”), between ______________, Contact Info: ____________, (hereinafter referred to as the “Broker”), and ________________, Contact Info: ____________ (herein referred to as the “Client”).
WHEREAS, the Broker shall take care of booking the Client’s vehicle under the Client’s terms.
NOW THEREOF, in consideration of the mutual covenants and promises made by the Parties hereto, the Parties covenant and agree as follows:
- TERM.
The initial term of this Agreement shall be for a period _______ [Days/Weeks/Months] commencing on the Effective Date herein.
- SCOPE.
The Broker shall provide pre-trip services including cleaning checklist, COVID-19 disinfectant, over 80 trip photos, and getting the Client’s vehicle booked. The Broker shall meet with the traveler, screen the travelers and verify the traveler’s identification papers.
Client’s Vehicle Registration details:

- PAYMENT/COMMISSION.
- The Broker shall get 15% from the monthly earnings.
- If so requested, the Client shall pay One Hundred and Twenty Dollars ($120) to have any of the following;
☐A vehicle Tracker Device.
☐SID devises.
☐Both.
- LIABILITY/INDEMNITY.
The Client understands that the Broker shall not be in possession and/or use of the vehicle(s) covered under this Agreement. The Broker shall not be held responsible for any damage caused to the vehicle by the traveler/renter during the term of this Agreement. The Client shall hold the Broker blameless and indemnify him against any claims related to the damages caused to the vehicle by the travelers.
- ASSIGNMENT/WAIVER.
- The waiver by either party of any breach or failure to enforce any of the terms and conditions of this Agreement at any time shall not in any way affect, limit, or waive such party’s right thereafter to enforce and compel strict compliance with every term and condition of this Agreement.
- This Agreement shall be binding upon and inure to the benefit of the Broker and the Client and their respective successors and assigns, provided that the Client may not assign any of their obligations under this Agreement without the Broker’s prior written consent.
- DISPUTE RESOLUTION.
In the event of disputes arising about the execution of this Agreement and/or performance of obligations stated herein, the Parties shall solve such issues through a mediation process.
- FORCE MAJEURE.
The failure on the part of the Broker to perform their obligation under this contract, will not be considered as default if such failure is the result of natural calamities, acts or God, Covid-19, extreme adverse disasters and circumstances beyond the control of the parties. The Broker shall inform the Client of such inconveniences promptly.
- TERMINATION/CANCELLATION.
The Parties acknowledge that either Party can terminate/cancel this Agreement at any time provided that they issue a _____ Day Written Notice on the same. The Client shall ensure to pay the Broker for all work done before the termination/cancellation is made effective. Either Party may terminate/cancel this Agreement at any time and without prior written notice if there is breach of any of the terms of this Agreement.
- MODIFICATION.
This Agreement contains the entire Agreement between the Parties relating to the subject matter hereof and supersedes any and all prior agreements or understandings, written or oral, between the parties related to the subject matter hereof. No modification of this Agreement shall be valid unless made in writing and signed by both parties hereto.
- GOVERNING LAW AND JURISDICTION.
This Agreement shall be governed by and construed in accordance with the laws ________ [State/Country] Exclusive jurisdiction and venue shall be in ___________ [State/Country]
