RENTAL AGREEMENT

This Rental Agreement (hereinafter referred to as the “Agreement”) is made and entered on this ____ day of _____ 20___ (the “Effective Date”), between ______________, Contact Info: ____________, (hereinafter referred to as the “Company”), and ________________, Contact Info: ____________ (herein referred to as the “Renter”).

WHEREAS, the Company rents out jet Skis and kayaks to residents and any interested clients within the State of Florida.

WHEREAS, the Renter hereby acknowledges and agrees that they are of lawful age (being aged 18 years and above) and that they have a driving license.

NOW THEREOF, in consideration of the mutual covenants and promises made by the Parties hereto, the Parties covenant and agree as follows:

  1. TERM.

The initial term of this Agreement shall be for a period _______ [Hours/Days/Weeks] commencing on the Effective Date herein.

  • PAYMENT

The Renter must pay $_____ deposit (non-refundable) on the Effective Date herein. Without the deposit, the Company doesn’t guarantee that the jet-ski or the kayak shall be available for the Renter on the booked dates.

  • REFUND.

The Renter shall only be given ___% refund if they cancel the Agreement in writing more than 24 hours before the official date of the service. If the Renter cancels the event less than 24 hours before the official date of the service, they shall not receive any refunds.

  • LICENSE/INSURANCE/MEDICAL TESTS.
    • The Renter must have the necessary (local, State or national) licenses and insurance required to be in possession of and use the Jet Ski or kayak. The Renter may be required to provide proof of medical tests before renting a Jet Ski or the kayak.
    • The Renter may be required to purchase the Company’s insurance policy, Personal Watercraft Insurance Policy that shall be active for the period of ____________. This purchase shall be negotiated between the Parties on the Effective Date.
  • LIABILITY.
    • The Renter is aware of the risks involved with the use of the skis and/or kayaks, and as such undergone training for the use and operation of the said skis and/or kayaks. The Renter shall not hold the Company and/or the Company’s employees liable for any injuries suffered during their possession of and/or use of the skis and/or kayaks. The Renter shall hold the Company blameless and indemnify it against any and all liability related to the possession and/or use of the skis and/or the kayaks.
    • The Renter shall be liable for any damage caused to the Jet Ski or Kayak while in their possession and/or use. The Renter shall be required to pay for any and all repairs.
  • ASSIGNMENT.

This Agreement shall be binding upon and inure to the benefit of the Company and the Renter and their respective successors and assigns, provided that the Renter may not assign any of their obligations under this Agreement without the Company’s prior written consent.  

  • MODIFICATIONS.

This Agreement contains the entire Agreement between the Parties relating to the subject matter hereof and supersedes any and all prior agreements or understandings, written or oral, between the parties related to the subject matter hereof.  No modification of this Agreement shall be valid unless made in writing and signed by both parties hereto.

  • GOVERNING LAW AND JURISDICTION.

This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, USA. Exclusive jurisdiction and venue shall be in Florida, USA

Each party represents and warrants to the other that such party has acted in good faith, and agrees to continue to so act, in the negotiation, execution, delivery, performance, and any termination of this agreement.
