This proposal and agreement are collectively hereinafter referred to as “Proposal” or “Agreement”. The proposal is offered by Advanced Restoration 1765. Rogers Ave, San Jose, CA. General Conditions

  1. Should Client, engineer, or inspector direct any modification requiring additional work other than what is covered under the contract, the cost shall be added to the contract price.

No addition to contract price without approval from Client

  • This proposal is based on a visual inspection of the job site by the Contractor. Should unforeseen conditions be encountered requiring additional work that could not reasonably be determined by such visual inspection, such additional work shall be performed by Contractor on a change order basis.
  • Contractor guarantees that all materials furnished will be of standard quality and will be installed or applied in good and working manner. Such labor and materials are guaranteed for a period of one (1) year subject to normal use and care, and provided Client has complied in full with the terms, payments, and other conditions of the contract. The liability of the Contractor for defective material or installation under this contract is hereby limited to the replacement or correction of said defective materials and /or installation. Client agrees that no other claims or demands whatsoever shall be make upon, or required be Contractor. Contractor maintains Worker’s Compensation Insurance as required by law.
  • In any legal action brought by either party to enforce the terms hereof, the prevailing party shall be entitled to all reasonable costs incurred in connection with such actions, including a reasonable attorney fee.
  • It is the policy of the Contractor to comply with California Mechanics’ Lien Laws and file such liens as required within thirty (30) days of the completion of the job if payment in full has not been received. The lien release shall be filed upon receipt of full payment.
  • Contractor may withdrawal the proposal after 30 days from the date offered.
  • The start date is determined by the Contractors’ schedule as of the written acceptance by Client, but no longer than thirty (30) days unless accepted by Client.
  • Client is responsible for obtaining any plans requested by City or County.
  • Contractor is not responsible for unforeseen/hidden conditions.
  • Bonds, testing, permits, and related fees are not included.
  • Notification of Utility companies regarding disconnect of services and meter by Client.
  • This contract is based on Contractor’s standard insurance coverage.
  • Contractor is performing and accepted on the job as a non-union shop.
  • Contractor shall not be held responsible for any delays beyond Contractor’s reasonable control.
  • Limitation of liability. Client and Contractor agree to release, indemnify, defend and hold Contractor, it’s agents, independent contractors and employees (hereinafter referred to as Advanced Restoration) harmless from all liability or claim, which are not created by Advanced Restoration’s negligence or willful misconduct.
  • In the event that an action is brought to enforce the terms of this contract the prevailing party shall be entitled to his reasonable attorney fees and costs.
  • In the event of any inconsistency between Contractor and Client this document, the terms of the document shall prevail.

Scope

Total $4,469.97

($) subject to adjustment for changes in the work as may be agreed to by the Client and Contractor.

The Client agrees to pay the Contractor in progress payments for ALL materials purchased and work completed. Payment will be due and payable within fifteen (15) days of invoice. Final payment to Contractor shall be made within fifteen (15) days of completion of the Contract and submission of final invoice to Client.

Scheduling

Work to be schedule immediately following execution of contract.

Contractor Licensing

Contractors are required by law to be licensed and regulated by the Contractor’s State License Board. Any questions concerning a contractor may be referred to the Registrar of the Board: Contractors State License Board, P.O. Box 2600, Sacramento, CA. 95826

Acceptance of Agreement

By signing below the parties agree to all the terms of the Proposal Agreement.

This is an estimate for mold remediation service at 227 South Claremont Ave. Due to shower pan leaking, room below became affected.

Containment will set in the living room to isolate the affected area. The affected ceiling will be cut and remove. The framing will be sanded, wire brush, HEPA vacuumed and sanitized. The structure will be monitor until dry.

This estimate does not include for post mold remediation clearance testing by a third party hygienist and it does not include and repair services.
