RE: RESPONSE TO EMAIL DATED _______________ (date the email was sent)

To: Modular Construction Limited

I write after due consideration of your email referenced ________(SUBJECT OF THE EMAIL) dated _______(DATE)

Pursuant to the content of the email sent to us by you, we would like to reject all claims made and make a counter offer in regards to the subject matter herein.

According to the contract signed by us and Great Land Construction Limited dated 23 October 2020, in relation to works at Lot 6, 481 & 483 Beach Road, Murrays Bay, any variation or modification is supposed to be made in writing and signed by both parties. However, the process of making the modification was not adhered to therefore amounting to breach of contract. For this reason, we reject all claims.

Additionally, we already paid all dues. Rework requires all the job and leftover job done by other contractors. We have already sent our invoices related to the rework and we want it paid with immediate effect.

We will be glad to negotiate with you if we receive payment to our solicitors trust account.

It is in the best interest of both of us to resolve this matter as soon as possible.

This letter has been construed in accordance with the laws of New Zealand.

Sincerely,
