This promoter’s Agreement (hereinafter referred to as the “Agreement”) is entered
into on ________ between ____ (hereinafter referred
to as the “Planner”) and __________ (hereinafter referred to as the
“promoter”) together referred to as the “Parties”.
WHEREAS the parties have willingly agreed to be legally bound by the following
terms; –
- Term
The parties in this Agreement agree that the terms and provisions of this Agreement
shall be legally binding upon the parties for a period of 1 year. - Event
On _____ the planner intends to host an event as described below; – - Payment
The parties agree that the promoter shall be entitled to 30% of the proceeds that the
planner receives from each of their work events. - Termination
The parties agree that either party may terminate this Agreement by issuing a prior
15 days’ written Notice stating the reason for termination.
The planner reserves the right to terminate the services of the promoter if he or she
does not promote the event or bring a crowd (more than __ people) to the
event. - Dispute Resolution
In case of any dispute/conflict arising from the performance and the provisions under
this Agreement, mutual negotiations shall resolve the same. If parties disagree, the
matter shall be referred to an approved mediator by both parties. - Modification
If any of the parties wish to modify any provision of this Agreement, they shall do so
in writing and be signed by both parties. - Severability
Suppose any provision of this Agreement is deemed invalid and unenforceable by a
court of competent jurisdiction. In that case, the provision shall be severed from this
Agreement, and the remaining provisions shall continue to be enforceable and
unaffected.
- Governing Law
The local laws of Melbourne shall govern this Agreement. - Entire Agreement
The parties herein agree that this Agreement constitutes the entire Agreement
between the parties and supersedes any prior oral or written Agreement or
negotiations.
