PHOTOGRAPHY AGREEMENT
This PHOTOGRAPHY AGREEMENT (‘’this Agreement’’) is entered into by and between __________________________ of address ___________________________ (“the Photographer”) and ________________________ of address __________________________ (“The Client”) on ________________________ (Effective date).
This agreement spells out the terms and conditions under which the services provided to the client and services performed by the Photographer will be executed.
In consideration of the premises, and of the mutual promises and undertakings herein contained, the parties, intending to be legally bound, do agree as follows:
- Services
The Photographer deals in the business of photography through indoors and outdoors photo-shoots.
By signing this agreement, the Client consents to their photos from the photo-shoots be used by the photographer for commercial purposes. This includes advertisements, marketing, branding in addition to any other use that the photographer will deem necessary.
The photographer will in turn offer the photo-shoots free of charge in addition to delivering the photos for free
The photographer offers one hour free sessions and delivers 10 edited images.
- Limitations of Liability
The Photographer is only liable to you for harm caused intentionally or by gross negligence. Exemption from or limitation on liability for damages under any relevant paragraph also applies to any claims that may exist against employees or agents of Photographer.
By signing this contract, you agree that under no circumstances shall the Photographer or its affiliates be liable for any direct, indirect, incidental, special or consequential damages that result from the photo-shoots taken and shared across platforms in the discretion of the photographer.
The above limitations of liability apply to all claims for damages no matter what the legal grounds may be, inclusive of tortuous acts.
- Indemnification
You agree to indemnify the Photographer and affiliates and hold us harmless against legal claims and demands that may arise from your use of our services. We reserve the right to select our own legal counsel in the event of a dispute.
- Governing laws
This Agreement shall be deemed to have been made, executed, and delivered in the State of _________________and shall be construed per the laws of the State of ______________.
