PHOTO RELEASE FORM
1) This contract is between _______________________ (Photographer) and
_________________________________ (Client or Clients). Both Photographer and
Client agree to abide by the full terms of this contract at all times.
2) The Client authorizes the Photographer to take images in the photography session of
_______________________(date (s)).
3) The Client agrees that the images belong to the Photographer and acknowledges the
rights therein belong to the Photographer, his/her heirs, legal representatives, and assigns,
those for whom the Photographer is acting, and those acting with his/her authority and
permission. They have the irrevocable, perpetual and unrestricted right and permission to
take, use, re-use, edit, alter, copy, distribute, publish, and republish the images in any and
all media now or hereafter known, specifically including but not limited to print media,
the Photographer’s portfolio and distribution over the internet for illustration, marketing
promotion, art, editorial, advertising, trade, or any other purpose whatsoever. The Client
understands and agrees that they will own all rights to their logos, and brand identity, but
that the Photographer may also share their content as advertising and marketing.
4) Photographer maintains full intellectual property rights to all images produced during the
photography session. No images shall be reproduced, altered, or distributed without prior
written consent from the Photographer.
5) Client agrees that Photographer cannot guarantee certain poses or images during the
photography session. Additionally, Client agrees not to hold Photographer liable for
compromised or poor-quality images due to lack of cooperation by image subjects or
events beyond their control such as weather conditions.
6) The Client affirms that such release to the releasee does not constitute any form of
compensation, including royalties arising from the images, to their benefit.
7) The Client hereby holds harmless, release, and forever discharge the Photographer from
all claims, demands, and causes of action which they, their heirs, representatives,
executors, administrators, or any other persons acting on their behalf or on behalf of their
estate have or may have by reason of this authorization including without limitation any
claims for libel or violation of any right of publicity or privacy.
8) There shall be a non-refundable deposit due upon booking and where the Client is a no-
show, the deposit shall be forfeited. The balance of the payment shall be made within
__________days of delivery, no photographs or content will be delivered until all
balances are paid in full.
9) Delivery of the photographs can take up to 6 weeks. One round of edits on photography
images is included provided that the Photographer is notified of any edits within 7 days
of delivery, a fee of $15.00 per photo per edit shall be applied after the 7 days. The
photographs will only be kept on file for 4 months.
10) The Client warrants that they have the right to contract and have read the above
authorization, release, and agreement, prior to its execution, and they are fully familiar
with the contents of this document. This document shall be binding upon them and their
heirs, legal representatives, and assigns.
11) If there are any disputes related to this contract at any time, both parties agree to resolve
those disputes according to the laws of the state of __________________. Any legal
disputes under this Agreement shall be settled through (select one)

12) This contract shall be the sole agreement between Client and Photographer. It supersedes
all prior oral or written agreements or understandings between the parties concerning the
subject matter of this agreement.
