PET CARE AGREEMENT

THIS PET CARE AGREEMENT (hereinafter “the Agreement”) is made and entered into
this day of _________________[Date], _________________[Month], Two Thousand and
Twenty-Three (2023).
BETWEEN;
1. _________________having a primary address at the following:

_________________ [Address]
(hereinafter “the Client”) of the first part;

AND

2. Erica’s Pet Care Co. having a primary address at the following:

_________________[Address]
(hereinafter “the Service Provider”) of the second part.

The Client and the Service Provider may be referred to individually as “Party”
and collectively as “the Parties”.

WHEREAS;
1. The Client wishes to retain the Service Provider to provide care for the Client’s
pet;
2. The Service Provider has the skills, qualifications, and expertise required to
provide the care for the pet and wishes to provide said care;

IN CONSIDERATION OF the promises and covenants herein, as well as other
good and valuable consideration (the receipt and sufficiency of which is hereby
acknowledged), the Parties do hereby agree as follows:

The care and services provided under this Agreement shall be for the following

2. DESCRIPTION OF SERVICES
The Service Provider and the Client hereby agree to the provision of the
following services (the “Services”):
☐Feed the pet(s) and change water bowls
☐ Walk and exercise the pet(s)
☐ Play with the pet(s)
☐ Clean up and dispose of any pet waste

☐ Brush and wash pet(s)
☐ Wash and tidy up bowls
☐ Administer medication
☐ Other:

3. PAYMENT
Fees are on or before the services described are provided. The total amount is
required to book a handler for any single service.
A receipt will be emailed to the Client upon placing an order for the desired
services.
The Clients that are invoiced at the end of the week will be charged FULL
AMOUNT for all the services.
Payments can be made via Zelle, Venmo, Cashapp, Apple Pay, PayPal, Cash,
and Debit/Credit Card.

4. CANCELLATION POLICY
The Client shall notify the Service Provider as soon as possible, if need be to
cancel all or part of the Services;
Cancellations are allowed up to 2hours before Walking and Drop-in Services. If
the Service Provider has arrived at the Client’s home or the Service Provider
are en route, and the Client cancels the Service(s), there is no refund or credit.
If the Client was on vacation and they make an early return, there is no refund
or credit of the payment.
No refunds will be given for cancellations of Boarding or Pet Daycare services
with less than 72 hours’ notice to the Service Provider.

5. EMERGENCIES
If there is an emergency, the Service Provider will make all reasonable efforts
to first contact the Client. If the Client is unable to be contacted, the Service
Provider shall contact the following:

In addition, the Client authorizes the Service Provider to seek and obtain
medical attention and treatment as deemed necessary by a veterinarian.
6. ACCESS AND SECURITY.
Should the Service Provider be given any keys, access codes, gate control
information, or other means of entry and access to the Client’s home or other
private space, the Service Provider hereby agrees to maintain the secrecy of all
such information and to share it with no one, as well as to return all such
access information and devices back to the Client at the termination of this
Agreement.

If the Client allows any other person(s) access to their home during the Service
Provider’ s contract period, the Service Provider shall not be held liable for any
damages to the Client’s property or pet(s) as a result. The Client shall also
notify the Service Provider if any person(s) will have access or be in the
Client’s home at the time of the Services.

7. LEASHES
All pet(s) will be required to be on a leash, and in the care, custody, and
control of the Service Provider’s handler.

If any pet(s) has control issues on a leash, is leash aggressive, or not properly
leash trained, said pet(s) will not be taken out of the Client’s enclosed or
fenced in property.

The Client is responsible for supplying a leash for their pet(s).

8. INJURY AND INDEMNIFICATION
If the pet(s) described in Section 1 accidentally dies, becomes ill, injured, or
lost, the Client waives and releases the Service Provider from any claim arising
from such an incident. If the pet(s) bites or injures the Service Provider’s
handler, any other human or animal, the Client will be responsible for any
resulting injury.

In addition, the Client shall hold harmless and indemnify the Service Provider
against any and all costs, expenses, losses, liabilities and claims arising out of
or relating to any acts of the pet(s) except if arising out of the negligence or
intentional misconduct on the part of the Service Provider.

The Service Provider shall not be liable for Pet(s) that cause damage to
furniture, carpet, flooring, and or wood.

9. Governing Law
The terms of this Agreement shall be governed by and construed in accordance
with the laws of the State of New York, not including its conflicts of law
provisions.

10. Severability.
If any provision of this Agreement is held to be invalid or unenforceable in
whole or in part, the remaining provisions shall not be affected and shall
continue to be valid and enforceable as though the invalid or unenforceable
parts had not been included in this Agreement.

11. Entire Agreement and Amendment.
This Agreement contains the entire understanding between the Parties and
supersedes and cancels all prior agreements of the Parties. This Agreement
may be amended or modified only by a written agreement signed by all the
Parties.
