[PROPOSED] ORDER GRANTING PERMANENT INJUNCTION

Plaintiff, Yamil Luciano, has filed a Complaint for Permanent Injunction against Defendants, Patrick Charles and Sheldeon Joiner. Having reviewed the papers filed in support of and in opposition (if any), and being fully advised, the Court finds that Yamil Luciano has demonstrated both a strong likelihood of success on the merits and the possibility that he faces immediate, irreparable injury from Defendants’ conduct. Accordingly, Yamil Luciano is entitled to permanent injunctive relief as follows:

Defendants are adjoined from defaming and otherwise telling vendors and clients that Yamil Luciano is no longer a member of SPL Logistics.  
All members of SPL Transport are adjoined from using any other checking or savings account other than the other ending in 3869.  
All other checking or savings account used to conduct company business shall be closed.  
Defendants shall direct RTS Financial to release the funds to SPL Transport’s checking account ending in 3869.  
Defendants shall return $3,850 received from invoice no. 3094060.  
Defendants shall refund $1,374.76 for the taking of Yamil Luciano’s truck registration plates.  
An indifferent CPA shall handle the funds with specific duties and the costs shall be divided equally among the three members.  
Defendants shall correct the state amended filing to state that Yamil Luciano is an equal member of SPL Logistics in conformity with the preformation business meeting held on 03/27/21.  
Defendants shall grant Yamil Luciano access to information and direct the respective vendors to authorize the transfer of information to Yamil Luciano, including but not limited to insurance companies, State of Texas entities, and Samsara ELD vendor.  
Defendants shall pay Yamil Luciano costs of this suit for malicious intent.  

This Permanent Injunction shall take effect immediately and shall remain in full force and effect.
