RE: OBJECTION FOR PROBATE

This letter’s objective is to oppose my brother, David Turner’s application which was made before this probate court for him to be named the executor of our father, Willy Cooper Turner. Before my father’s death in 2019, I was his court appointed legal guardian, I took care of him when he was sick, took him for his hospital visits and provided him with necessary care and attention until his untimely demise. Before his death, my father had signed papers to make me his power of attorney. 

I am objecting my brother’s application because he did not include all family members in the documents before this court. For example, he did not include our oldest brother Michael Turner on the papers. Michael Turner is our oldest brother from our father’s first marriage. Secondly, I am objecting his application because I was appointed the power of attorney by my father. A power of attorney is allowed to act on behalf of the principal. He may be authorized to handle bank accounts, sign checks, sell property, manage assets, and file taxes for the principal. Thirdly, I am objecting my brother’s application because I took care of my father when he was ailing, therefore, I have his best interests at heart.

I believe given a change to be the executor of my father’s estate I will consider all his beneficiaries and execute his estate according to the will of my father and considering all the interests of his beneficiaries.  I aver that my brother, David Turner is not a fit executor of my father’s estate as none of my other siblings want him as the executor of the estate. Additionally, we believe that his motivation to be the executor of the estate is motivated by selfish interest rather than good faith.
