MEMORANDUM IN SUPPORT OF MOTION FOR APPOINTMENT OF CONCILIATION SERVICES
NOW COMES Jonathan Rose, Petitioner, before this Honorable Court, and brings this Motion for Appointment of Conciliation Services, and hereby avers as follows:
- This Motion is brought pursuant to L.R. Prac. Sup. Ct. 10 and Rule 68 of the Arizona Rules of Family Law Procedure.
- Petitioner and Respondent got separated in (Insert Year). Prior to the separation, they had two children: Natasha Rose born on 04/06/08 and David Charles Rose born on 03/04/10 (the “minor children”).
- Petitioner has full legal and residential custody of the minor children. The parties follow a Separation Agreement and Parenting Plan issued by the District Court, Denver County Colorado, dated 06/18/2015. Petitioner moved to Arizona with the minor children in (Insert Year).
- The award of full legal and residential custody of the minor children to Petitioner and the Separation Agreement and Parenting Plan by the District Court, Denver County Colorado were done in the best interests of the minor children.
- Respondent would like to deviate from the Separation Agreement and Parenting Plan by filing for joint custody. She has filed for joint custody in the past but it wasn’t granted.
- Petitioner avers that the minor children have indicated multiple times that they don’t want to live with Respondent because…
- Petitioner would like to retain full legal and residential custody of the minor children since it is in their best interests not to stay with Respondent.
- This Motion is being made in good faith.
REASONS WHEREFORE, Petitioner respectfully requests this Honorable Court to grant him the following:
- To appoint conciliation services to resolve the dispute between Petitioner and Respondent; or
- To appoint a best-interest attorney or advisor to act on behalf of the minor children;
- Such equitable relief as may be appropriate under the circumstances; and
- Award such further relief as this Honorable Court deems necessary and proper.
