MUTUAL AGREEMENT

This mutual agreement is entered into [Date] “Effective Date) by and between

Now therefore, the Company and the former employee intending to be legally bound by these terms agree to the following:

  1. The Agreement
  2. The Parties herein agree to be bound by the terms of this contract. Any breach of this contract shall lead to a legal action taken against the party at fault.
  3. Former employee agrees to be on her best behavior during the vacation. In the event the former employee acts in a way that threatens to infringe this contract or the rights of the Company or the former employer, the former employee shall be discontinued from the vacation and shall not be allowed to carry on with the group.
  4. Former employee agrees not to speak negatively of the Company she used to work for or the Employer.  
  5. The former employee shall not be refunded if she violates the terms of this agreement.
  6. Term of the Contract

This contract shall be effective for three years (3 years) from the date of signing of this contract (Effective date).

  • Payment terms

[Name of employee] shall pay $ 3841.00 for the vacation and $580 for the one way flight. An additional $ 265 in sales tax shall be paid. All the payments shall be made within 24 hours of the signing of this agreement.

  • Non-Compete Clause.

For the entire duration of this agreement [Name of employee] shall not engage in any activity that poses unwarranted competition with the Company.

  • Former Employee’s Acknowledgement

[Name of employee] acknowledges that she have been provided with the opportunity to negotiate this agreement, have had the opportunity to seek legal counsel before signing this agreement, and that the restrictions imposed are fair and necessary for the Company’s business interests. Finally, the Party agrees that these restrictions are reasonable and do not constitute a threat to their livelihood.

  • Liability Clause

[Name of employee] hereby further agrees that, in the event of its breach or threatened breach of this Agreement, the Company would suffer irreparable harm and the Company’s remedies shall include, in addition to any other remedies available at law or in equity, equitable remedies such as specific performance and injunctive relief and shall not be limited to monetary damages. Specifically, the Company shall be entitled to seek immediate injunctive relief prohibiting such violation.

  • Dispute Resolution

In the event of a dispute between the parties, parties shall resolve to litigation. The party at fault shall bear all costs of litigation.

  • Applicable law

This Agreement and its interpretation shall be governed by the laws of FLORIDA. Any dispute that may arise from this agreement shall be adjudicated in a court of competent jurisdiction in the state mentioned herein.
