THIS MUSIC PERFOMANCE AGREEMENT (hereinafter “the Agreement”) is made on the…………day of XXX


Miami Events and Productions, Company domiciled and carrying out business along 4911 SW 27th Ave, Fort Lauderdale, FL 33312, within the state of XXX (hereinafter “the Company”) of the one part; and

………………of 777 Brickell Ave. Suite 500, Miami FL 33131 within the state of Florida, USA (hereinafter “the Client”) of the other part.



  1. The Company carries out the business of music performance;
  2. The Client is desirous of sourcing the music performance services of the Company (hereinafter “the services”);
  3. The Client has agreed to render the music performance services in accordance with the terms and conditions set out in this Agreement.



  1. Operative
    • The Client hereby appoints the Company to render the services for a period of ……………hours at an event which shall be convened by the client at FONTAINEBLEAU Miami Beach4441 Collins Ave, Miami Beach, FL 33140 at the event dates/time set out in appendix 1.


  • The Company hereby agrees and covenants to provide a competent artist, to perform the services at the aforesaid venue and time.
  • It is expected and understood that in performing the services under this agreement, the Company and the artist will exercise the highest possible degree of skill.


  1. Consideration/payment
    • In consideration of the Company undertaking the services set out in this Agreement, the Client shall pay the Company a sum of $3800.00 plus tax = $4066.00.


  • Upon execution of this Agreement, the Client shall pay a 50% deposit of the consideration, being a sum of $2033.00 The remainder of the consideration will be collected one week prior to the event date (August 30,2019).


  • Over-time kicks in at an additional 15 minutes past the accorded times. Over-time will be pro-rated at a $1200.00 Dollar amount per 60-minute performance.


  1. The Company’s covenants

The Company and its artist hereby covenant with the Client that it shall undertake the services set out under Clause 1 above by:

  1. Providing the requisite Sound System/Rider;
  2. Providing competent artist for the agreed events;
  3. To perform the obligations under this agreement, in all respects, in good faith.
  4. Taking such further steps which may be reasonably necessary.


  1. The Client’s covenants

The Client hereby covenants to:

  1. Pay all the consideration as agreed under this Agreement;
  2. Provide the artist with lighting;
  3. Place the artist in a location free from obstruction by tables, persons or other objects;
  4. Provide the artist with a room for him and his musicians to change attire and store belongings;
  5. Provide the artists with Jack Daniels In the event the Client is unable to provide this, the Client shall inform the artist in advance.
  6. Provide the artist and his Band with water during the performance.
  7. Provide the Band with drinks and a meal during their break, as follows:

Day 1: A total of 6 vendor dinner meals;

Day 2: Breakfast, lunch and dinner for three. Total of 9 vendor meals for that day;

Day 3: We need breakfast and lunch. Total of six vendor meals.

  1. Providing the Band with valet parking as follows:

Day 1: Six (6) valet parking;

Day 2: Four (4) valet parking;

Day 3: Three (3) valet parking vehicles.

  1. To perform the obligations under this agreement, in all respects, in good faith.
  2. Taking such further steps which may be reasonably necessary.


  1. Force Majeure

Neither the company nor the Client will be held liable for any failure to perform its obligations under this agreement where such breach is due to any of the following proven detention: inclement weather, epidemic, acts of God, or any other legitimate cause beyond the reasonable control of the Performer and the Client. If the Artist are unable to perform, Company will take reasonable measure to provide a suitable alternative


  1. Default and remedies

If either party defaults in performance its obligations under this agreement, the other party shall have all remedies available at law or in equity. The prevailing party in any litigation, arbitration or mediation of a default shall be entitled to recovery of its attorney’s fees and costs from the non – prevailing party.

  1. Dispute resolution

All disputes or differences which shall at any time arise between the parties concerning any matter in relation to this Agreement shall be resolved amicably through conciliation, negotiation or Arbitration.


  1. Governing law

This Agreement shall be construed and enforced in accordance with the laws of the state of Florida.


  1. Entire Agreement/amendments

This contract represents the complete agreement between the parties. As such, any changes or modifications to the contract can only be made by a mutual agreement of the parties in writing.
