SUBJECT: Memorandum of Record Appeal

Dear Sir/Madam,

I acknowledge receipt of the Memorandum of Record dated May 27, 2021.

I wish to respond to the same by making this appeal against the investigation process for reason that the interview exercise conducted by the investigating officer may unknowingly have granted an unfair advantage to the subject of the complaint.

It is my knowledge and belief that placing female trainees in a class group where the vast majority are male trainees is discouraged and frowned upon. It is also my knowledge and belief that the school is under investigation for continuing to maintain such unwelcomed practices.

The events of the complaint took place during a training exercise. I was the only female in a class of 60 male trainees. As such, rather than being kept in a separate thermal shelter, I was placed inside a thermal shelter with two male soldiers. One of them, the subject, proceeded to stimulate his genitals in a sexual manner while lying next to my person in the shelter. Following the events, I promptly lodged a sexual harassment complaint against the subject.

Pursuant to Army Regulation 600-20, each complaint received by the SARC shall be subjected to thorough examination of the facts. To realize this, it is required that the Complainant and the subject of the complaint be invited to provide further information on the events.

I do confirm that indeed I received such an invitation. However, the interview was conducted over a telephone conversation where the information I provided was limited to vocal transmission and could not convey any intended demonstrations, which demonstration required physical coordination on my part. On the other hand, the subject was also invited to give their information to the investigating officer. However, contrary to my interview, the subject was invited to a physical interview with no limitation. In addition, fellow members of the platoon, some of who share a bond with the subject, were also invited to a physical interview to give their testimonies regarding the events giving rise to the complaint.

On May 24th, 2021, COL Lange and SFC Feick invited me to a sit-down session where among other things, I was given notice of the investigation results. As easy as it was to invite me physically for the notice, so should it have been for purposes of obtaining clear and accurate information.

As it stands, I am unable to obtain a copy of the full investigation report as the same is only issued through FOIA, who are yet to resume operations. Furthermore, Monday 31st May 2021 shall be Memorial Day and all non-essential offices will be closed. On June 1st, 2021, I shall be transferred to Fort Wainwright, where I will await deployment to Poland on June 4th, 2021. Nonetheless, I am required to submit an appeal within a limited seven (7) day period, which I do so herein.

It is my firm belief that denial of a physical interview where I could have demonstrated the conduct and actions of the subject gave an unfair advantage against me. I pray you take into consideration the contents of this letter and grant an appeal on grounds of a tainted investigation procedure.
