RE: Case No. 654858/16E – 436 West 52 LLC v Angela Sheila Sillador

Your Honor, my name is Angela Sheila Sillador and I’m the Defendant in the above case. I am writing this letter to dispute the claim made by Mr. Insert Landlord’s Name.

My friend, Fabio Lopes Soares, signed a lease with the Plaintiff for an apartment located at 436 West 52 and listed me as a co-signor of the lease. He didn’t inform me that he had listed me as a co-signor. I was not given any lease to sign nor did I live in the apartment. Mr. Soares defaulted on payment and owed money to Mr. Insert Landlord’s Name. As a result, my check was garnished. That’s how I came to find out that Mr. Soares had listed me as a co-signor without my prior permission and consent.

Mr. Soares went to court and took ownership of the responsibility of solely paying money owed to Mr. Insert Landlord’s Name as rent. He also filed for bankruptcy and his debts were discharged, including dues for the apartment on 436 West 52. I was listed as a Defendant in this case for unpaid dues for the apartment on 436 West 52 by Mr. Soares. Mr. Insert Landlord’s Name requested for a hearing on 03/17/21 but there has been no communication from the court on that request.

Mr. Insert Landlord’s Name provided a copy of the lease and it showed that I didn’t sign any where on the lease. Contractual obligations in a contract only apply to parties of that contract. I was not a party to the lease. I have no obligation to pay Mr. Insert Landlord’s Name unpaid dues by Mr. Soares because I did not sign the lease. I was not a party to the lease; therefore, I have no contractual obligation in regard to the lease signed between Mr. Insert Landlord’s Name and Mr. Soares.

Your Honor, the doctrine of freedom of contract gives me the right to choose whether or not to enter into a contract. I did not choose to co-sign the lease with Mr. Soares nor did I express an intention to be bound by the lease by signing it. I should not be bound by the terms of a lease to which I’m not a party.

I did not sign the lease. The signature is a forgery. It is not fair that Mr. Soares forged my signature on the lease, failed to pay his dues, filed for bankruptcy, got discharged from his financial obligations, and I’m being asked to pay his dues by Mr. Insert Landlord’s Name. Granting the Plaintiff will be aiding this unfairness. 

I’m representing myself since I can’t afford to pay an attorney. This case has been dragging on for more than 5 years. I’ve been jobless for a year due to the pandemic and recently got employed. Mr. Insert Landlord’s Name wants me to pay the money owed to him by Mr. Soares with full knowledge that I did not co-sign the lease. In the interest of fairness and justice, I’m asking that you please dismiss this case. Thank you for your attention.
