RE: REQUEST FOR LETTER OF INQUIRY

I am writing this letter to request a letter of inquiry from your office pertaining to the unjust charges against me. Herein, I shall also provide factual evidence that brings out the said injustice.
On or about February 27, 2020, I was charged with two counts of handing in fraudulent documentation. On or about March 30, 2020, I attended the hearing of my case. At the hearing, the Commander found me guilty of these counts because of inconsistencies. The ruling was made despite the lack of sufficient evidence to prove my guilt beyond reasonable doubt. It would suffice to mention that I answered every issue raised to the best of my knowledge, information, and belief. I was willing to retrieve any information required to satisfy their concerns. I also issued a testimony that was corroborated by a Staff Sergeant. Notably, the Staff Sergeant was not called a witness at the hearing.
The Commander relied on the evidence of an admission I made that I did not follow the Army procedure in taking the Army Physical Fitness Test. Pressed with family commitments, I found myself short on time to complete the paperwork for the test and thereby requested a fellow soldier’s assistance. I did not falsify the information in the reports I submitted. It follows; the contents of the reports are true, accurate, and exact. I was willing to retake the test but only received written counseling on the matter.
Accordingly, I had to appeal the decision to the Judge Advocate. At this stage, I hired a lawyer to represent me. The appeal went up to the next level and was denied immediately within an hour. The Judge Advocate at that level wrote on the paperwork that the Commander’s decision at the Non-Judicial Punishment (“NJP”) may not be fraudulent.
I do not deserve the non-judicial punishment I received for lack of sufficient evidence to find me liable. Besides, the Commander failed to consider my clean record. Before I was charged, I was a Sergeant First Class (SFC) in the army. I have always offered my service wholeheartedly since I joined the army. I have gained recognition for my leadership skills and the value I add to the job. I am also active in my community as a volunteer and the local Veterans of Foreign Wars. Accordingly, my sixteen-year duration of service is without blemish. Part V of the Manual for Courts-Martial provides that Commanders considering non-judicial punishment should consider the nature of the offense, the record of the Servicemember, the need for good order and discipline, and the effect of non-judicial punishment on the Servicemember and the Servicemember’s record. Accordingly, the Commander went against the guidelines and failed to consider my clean record and the impact of the punishment on me.
Another evidence of the injustice committed at the NJP is that another soldier was getting an Article 15 for doing the Army Physical Fitness Test (“APFT”). By the end of his hearing, they found him not guilty, and he was not subjected to any penalty. On the other hand, I was penalized my First Sergeant (“1SG”) position, and they took away my SFC rank.
It follows; I am confident that the aforementioned information will be crucial in drafting your letter of inquiry in a bid to seek redress for the said injustices against me. I pray that you put my matter into consideration.
