There is something called Statute of Limitations. This means that there is a set time period within which you should have filed your case in court, after which you cannot bring the case before the court. The statute of limitations for child sexual abuse cases is 12 years. You told me the sexual assault happened in 2009. Which month of 2009? You need to act immediately and respond without delay.

The statute of limitations for civil cases is 2 years. You told me the assault (head injury) happened in 2009. You should have sued by 2011. I’m sorry but you can’t sue for the head injury.

If you are still within the statute of limitations for child sexual abuse, you can speak to a prosecutor to bring the case on your behalf. You and your son will be complainant’s and your mother’s husband the defendant. The abuser will be arrested and charges brought against him.

In regard to getting your children back, you should find the order that placed them in the care of other people and file a Motion to get the order modified because the initial judge was corrupt as well as change of circumstances. You should have proof that the judge was corrupt. Also, you should demonstrate a positive change of circumstances that mean you have the ability to take care of your children.
