JET SKI RENTAL RELEASE OF LIABILITY AGREEMENT

This Jet Ski Rental Release of Liability Agreement (the “Agreement”) is made and entered into between:

  1. [Your Name or Business Name], hereinafter referred to as the “Owner,” and
  2. [Customer’s Name], hereinafter referred to as the “Renter.”

The Owner and Renter shall collectively be referred to as the “Parties.”

RECITALS

WHEREAS, Owner is the lawful owner of the jet ski identified as [Jet Ski Make/Model/Serial Number], hereinafter referred to as the “Jet Ski.”

WHEREAS, Renter desires to rent the Jet Ski from Owner for a specified rental period.

WHEREAS, Owner and Renter acknowledge that operating a jet ski involves inherent risks and potential hazards.

WHEREAS, Owner and Renter wish to enter into an agreement that outlines the terms and conditions of the Jet Ski rental, including the allocation of responsibilities and the release of liability.

NOW, THEREFORE, in consideration of the mutual promises and covenants contained herein, and for other good and valuable consideration, the sufficiency of which is hereby acknowledged, the Parties agree as follows:

  1. Jet Ski Details:

  2. Rental Period:

  3. Rental Fee:
    • The Renter agrees to pay the Owner the total rental fee of [Rental Fee] for the Jet Ski, payable in full prior to the commencement of the rental period.
  4. Assumption of Risks:
    • The Renter acknowledges and understands that operating a jet ski involves inherent risks, including but not limited to property damage, personal injury, and death.
    • The Renter affirms that they are physically and mentally capable of operating a jet ski and possess the necessary skills, knowledge, and experience to do so safely.
    • The Renter assumes all risks associated with the operation of the Jet Ski, including but not limited to accidents, collisions, loss of control, submerged hazards, and changing water and weather conditions.
    • The Renter acknowledges that it is their responsibility to familiarize themselves with the proper operation of the Jet Ski and to follow all safety instructions, guidelines, and regulations provided by the Owner.
  5. Release and Indemnity:
    • In consideration for the rental of the Jet Ski, the Renter hereby releases, discharges, and holds harmless the Owner, its owners, employees, agents, and representatives from any and all liabilities, claims, actions, damages, costs, or expenses, whether arising from negligence or any other cause, related to the Renter’s use and operation of the Jet Ski.
    • This release and indemnity shall apply to all claims, demands, and causes of action, whether known or unknown, anticipated or unanticipated, arising out of or in connection with the Renter’s rental of the Jet Ski.
    • The Renter agrees to defend, indemnify, and hold harmless the Owner from any liabilities, claims, actions, damages, costs, or expenses, including attorney fees, arising from the Renter’s use and operation of the Jet Ski, regardless of whether such liabilities, claims, actions, damages, costs, or expenses are caused by the Renter’s negligence or the negligence of the Owner.
  6. Responsibility for Damages:
    • The Renter accepts full financial responsibility for any damages caused to the Jet Ski during the rental period, including damage due to negligence, improper use, or failure to follow operating instructions.
    • The Renter agrees to promptly notify the Owner of any damages to the Jet Ski incurred during their rental period and to reimburse the Owner for the full cost of repair or replacement, including parts, labor, and associated expenses.
  7. Compliance with Laws and Regulations:
    • The Renter agrees to operate the Jet Ski in compliance with all applicable laws, regulations, and restrictions, including but not limited to boating laws, waterway rules, and any rules or guidelines set forth by the Owner.
  8. Governing Law and Jurisdiction:
    • This Agreement shall be governed by and construed in accordance with the laws of [Your State/Country].
    • Any legal actions or disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the courts in [Your State/Country].
  9. Entire Agreement:
