HOME CARE SERVICE AGREEMENT
This agreement made on this ____ day of ___________, _____, by and between ___________________ (hereafter referred to as the “Client”), and ___________________ (hereafter referred to as the “Agency”).
- Term.
The parties agree that this Agreement shall be effective as from ________ until the Client does not need the services.
- Services.
The Agency shall provide to the Client a caregiver who shall carry out the following services identified by the Client.
- Schedule.
The parties agree to the following schedule; –
- Monday – Saturday 6pm – 12 am
- Sunday 8pm – 4am
- Compensation.
The parties herein agree that the Client shall compensate the Agency for the services provided at $ ________ weekly.
The payment shall be made every week on Friday on or before 1 pm.
- Indemnity.
The parties herein fully understand that the caregiver is a non-medical provider is not licensed to perform medical services. The Client indemnifies, jointly, and severally against any claims, actions, suits, demands, liabilities, and proceedings both at law and in equity, arising from the negligent acts or omissions of the caregivers and against the Agency.
- Termination.
Either party to this Agreement may terminate the services herein upon issuing a seven days prior written notice to the other party.
The Agency may terminate this Agreement for reasons which are not limited to; –
- Failure to pay on time.
- Harassment of the caregiver.
- Governing Law.
This Agreement shall be governed and construed in accordance with the laws of the state of California.
- Dispute Resolution.
In the event of any dispute which may arise from this Agreement, the same shall be negotiated between the parties. If it fails, the dispute shall be referred to mediation in accordance with the laws of the state of California.
- Severability.
In case of any provision or term contained in this Agreement shall be held to be invalid or unenforceable, the term or provision will be severable from the rest of the Agreement. It shall not affect the validity of the other Agreement terms, which shall remain in full force and effect.
- Waiver.
The waiver by the Agency of a breach of any provision of this Agreement by the Client shall not operate or be construed as a waiver of any subsequent or continuing breach of this Agreement by Client and vice versa.
- Assignment.
The parties herein may not assign their rights, duties, and obligations under this Agreement without the prior written consent of the other party.
- Entire Agreement.
This Agreement constitutes the entire Agreement between the parties concerning the subject matter and supersedes and replaces all prior oral or written representations or agreements.
THIS IS A LEGALLY BINDING CONTRACT. EACH PARTY HAS READ THE ABOVE AGREEMENT BEFORE SIGNING IT. EACH PARTY UNDERSTANDS THE AGREEMENT THAT HE OR SHE IS MAKING.
