  1. DECLARATION

I, Gretchen Mac Miller, a resident of [State] and being of sound mind and memory, do hereby make, publish and declare this to be my last will and testament, hereby revoking all Wills, Codicils and other testamentary dispositions previously made by me.

  1. FAMILY

I declare that I am married as of the date of this Will and that my wife’s name is Gretchen Valeria. I further declare that I have four children, namely: Rosette Mia Miller, Ryan Kim Miller, Bernie Porte Miller, and Christine Miller. If subsequent to the execution of this Will there shall be an additional child or children born to or adopted by me, I direct that such birth or adoption shall not revoke this Will.

  1. DOMICILE

I declare that I am domiciled in California and that in so far as possible the interpretation and administration of this my Last Will and Testament shall be guided or where applicable governed by the laws of California.

  1. APPOINTMENT OF EXECUTORS AND TRUSTEES

I nominate, constitute and appoint my daughter, Rosette Mia Miller and my son Ryan Kim as Executors and Trustees (hereinafter together referred to as “my Trustees”) under this Will, hereby giving and granting unto my said Trustees all such power and authority as is allowed in law especially that of assumption and, reposing special trust and faith in them, direct that no bond or other security be required for the faithful performance of their duties or, if bond is required, that sureties thereon be waived. In addition to any other powers that may be conferred by law, I give my Trustees under this Will, including any successor or successors thereto, those powers set forth in the applicable Law of Succession. My Trustees may from time to time invest in addition to their powers under the general law the balance of my estate or any part or parts thereof in any way in which they in their absolute discretion think fit in all respects as if they were the beneficial owners of such monies.

  • DEBT

I direct that as soon as is practical after my death, the executor named pursuant to this Will review all of my just debts and obligations, including last illness and funeral expenses, except for those secured long-term debts that may be assumed by the beneficiary of such property, unless such assumption is prohibited by law or on agreement by the beneficiary. The executor is further directed to pay any attorneys’ fees and any other estate administration expenses. The executor shall pay these just debts only after a creditor provides timely and sufficient evidence to support its claim and in accordance with applicable state law.

I direct that any estate, inheritance, and succession taxes, including any interest and penalties thereon, imposed by the federal government or any state, district, or territory, attributable to assets includible in my estate, passing either under or outside of this Will, be apportioned among the persons interested in my estate in accordance with applicable state and federal law. My executor is authorized and directed to seek reimbursement from the beneficiaries of my estate of any taxes paid by my executor to the extent allowed by law.

If my executor cannot collect from any person interested in the estate the amount of tax apportioned to that person, the amount not recoverable will be equitably apportioned among the other persons interested in the estate who are subject to apportionment.

  • SPECIFIC BEQUEST
  • The persons named below shall be given the following specific bequests, if owned by me at the time of my death:

To my daughter, Rosette Mia Miller, I give: My sculpture collection.

If said beneficiary does not survive me, this specific bequest will be distributed to Christine miller. If the alternate beneficiary fails to survive me, this specific bequest will lapse, be added to the residue of my estate, and be distributed to my remainder beneficiaries as set forth below.

  • I give to the persons named below the following digital specific bequests, if owned by me at the time of my death:

To my son, Ryan Miller, I give: My digital family photo collection stored in my home computer.

If said beneficiary does not survive me, this specific bequest will be distributed to: Bernie Porte Miller. If said alternate beneficiary does not survive me, this specific bequest will lapse, be added to the residue of my estate, and be distributed to my remainder beneficiaries as set forth below.

  • GENERAL BEEQUEST

I hereby leave $ 100,000 to my wife Gretchen Valeria, $ 30,000 to my daughter Rosette Mia Miller, 30,000 to my son Ryan Kim Miller, $ 10,000 to my son Bernie Porte Miller, and $10,000 to my daughter Christine Miller.

  • APPOINTMENT OF GUARDIAN

If my wife, Gretchen Valeria, does not survive me, I nominate and appoint my sister, Daisy White of address [Address] as guardian of the person and property of each of my minor children. If my sister, Daisy White, predeceases me or fails to serve as guardian for any reason, then I nominate and appoint my aunt, Lucia Annette, as guardian of the person and property of each of my minor children. I direct that no bond or other security shall be required for the faithful performance of their duties or, if bond is required, that sureties thereon be waived.

  1. REVOCATION OF PREVIOUS WILLS

I hereby revoke all wills and codicils that I previously made.

WITNESSES

We, the witnesses herein, append our names and signatures to this document. We declare that the testator signed and executed this document as the testator’s last will.

In the presence of the testator and each of the witnesses mentioned herein, we sign this will as witnesses to the testator’s signing.

To the best of our knowledge, the testator is an adult of a sound mind and under no constraint or undue influence and who is legally empowered to make a will.
