EVENT PLANNING AGREEMENT.

This Event Planning Agreement (hereinafter referred to as the “Agreement”) is made and entered on this ___ day of __ 2021 (the “Effective Date”), between _______________, Contact Info: ___________________ (hereinafter referred to as the “Planner”), and __________, Contact Info:  ___________, (herein referred to as the “Client”).

NOW THEREOF, in consideration of the mutual covenants and promises made by the Parties hereto, the Parties covenant and agree as follows:

  1. TERM.

The initial term of this Agreement shall be for a period ______ [Hours/Days/Weeks] commencing on the Effective Date herein.

  • SCOPE.
    • The Client is hiring the Planner for event planning services, the Planner’s obligations shall include:

  • The Planner shall communicate with the Client any and all changes 72 Hours prior to the event date.
  • PAYMENT, BOOKING AND CANCELLATION.
    • All events must be booked at least Sixty (60) Days before the event date, any amount paid after will not receive a refund if cancelled.
    • The Client shall pay ____________ Dollars for the services provided herein, 40% deposit is due to secure the event date, the balance shall be paid on or prior the due date.
    • Any event cancelled within 48 hours of booking shall receive a full refund of the deposit made.
    • Any event cancelled within 30 days of booking shall receive 50% refund of the deposit made.
  • CLIENT OBLIGATIONS.
  • Provide the Planner with the theme and color scheme for the event.
  • Make all payments on or prior to due date.
  • Communicate any and all changes 72 Hours prior to the event date.
  • Provide venue information (unless it is a part of the Cinematic experience package).
  • The Client shall not be at the venue while the Planner is decorating, this is because clients often get anxious if present and/or fail to see/understand the Planner’s vision/concept.
  • The Client shall advice their guests not to remove any of the Planner’s items.
  • Shall not be required to assist with clean up after the event unless so requested by the Planner.
  • LIABILITY/INDEMNITY/WAIVER.
    • The Planner and/or any person contracted by the Planner under this Agreement understand that they shall be responsible for their health and safety during the term of this Agreement. The Planner and their persons shall not hold the Client responsible for any injuries sustained while they are performing their obligations under this Agreement unless such injuries are as a result of the Client’s negligence.
    • The waiver by either party of any breach or failure to enforce any of the terms and conditions of this Agreement at any time shall not in any way affect, limit, or waive such party’s right thereafter to enforce and compel strict compliance with every term and condition of this Agreement.
  • FORCE MAJEURE.

The failure on the part of the Planner to perform their obligation under this Agreement will not be considered as default if such failure is the result of natural calamities, acts or God, Covid-19, extreme adverse disasters and circumstances beyond the control of the parties.

  • DISPUTE RESOLUTION.

In the event of disputes arising about the execution of this Agreement and/or performance of obligations stated herein, the Parties shall solve such issues through a mediation process.

  • TERMINATION.
    • The Client may terminate this Agreement by offering the Planner a written notice explain reasons thereto, which may include, Client not being 100% satisfied with the final outcome of the event and/or the invoice does not match what had been provided.
    • The Planner may terminate this Agreement by offering the Client a written notice if the Client is rude, aggressive or if the guests are being rude or aggressive towards the Planner, and/or if payment is not made up to 24 hours after due date and no communication has been made by the Client.
  • MODIFICATION.

This Agreement contains the entire Agreement between the Parties relating to the subject matter hereof and supersedes any and all prior agreements or understandings, written or oral, between the parties related to the subject matter hereof.  No modification of this Agreement shall be valid unless made in writing and signed by both parties hereto.

  1. GOVERNING LAW AND JURISDICTION.
    1. This Agreement shall be governed by and construed in accordance with the laws ________ [State/Country] Exclusive jurisdiction and venue shall be in ___________ [State/Country]
    1. This Agreement shall be binding upon and inure to the benefit of the Planner and the Client and their respective successors and assigns, provided that the Client may not assign any of their obligations under this Agreement without the Planner’s prior written consent.
