EMPLOYMENT CONTRACT

This employment contract is made on this ____________________ between ___________________  (hereinafter referred to as the “Employer”) and _____________________ (hereinafter referred to as the “Employee”). Together referred to as parties.

Whereas the Employer and the Employee have agreed to be mutually bound by the following terms of the Contract; –

  1. Term.

The parties herein agree that the services provided by the Employee shall be for a period of __________.

  1. Duties.

The duties and responsibilities of the Employee as agreed are as follows; –

  1. Planning
  • The Employee will examine all previous and current workplace standards, rules, and day-to-day operating processes during the planning phase.
  • The Employee will conduct a preliminary evaluation of all relevant data and procedures for review. 
  1. Fieldwork 
  • The fieldwork phase is the most time-consuming aspect of the review. 
  • The Employee will collect data on operations, understand the fleet’s activities, and evaluate both advantages and disadvantages. 
  1. Report
  • The results of the fieldwork will be collated, presented, and evaluated with the client’s management. 
  • All concerns must be addressed acknowledged, and the Employer must offer an implementation plan and timetables. 
  1. Follow-Up
  • The Employee will make a follow-up in accordance with the timeline laid out in the implementation plan to confirm that the relevant procedures and actions have been implemented as agreed.
  1. Review
  • The Employee will give the Employer a full breakdown of each step, and during the presentation, any additional considered proposals will be discussed.
  1. Compensation.

In consideration of the duties and responsibilities being carried out for the Employer, the Employee shall receive a compensation of $ ____________

The payment of the above-stated compensation shall be done in a lump sum and before the Employee starts his performance of the duties herein. 

  1. Confidentiality.

The Employee herein acknowledges that during the performance of the duties and responsibilities listed in this Contract, they will come across confidential information and agree not to disclose or share with any third parties not privy to this Contract without prior written consent from the Employer.

The Employee agrees to the term mentioned above of the Contract, and failure to comply or breach thereof shall terminate the Contract immediately.

  1. Liability.

The Employer acknowledges and agrees to indemnify the Employee from any liabilities, i.e., claims, legal suits, damages, or loss that may be brought up due to the services provided by the Employee under this Contract.

  1. Termination.

The parties agree that the contract is for ________. However, either party has a right to terminate this Contract by issuing 30 days’ written notice to the other party.

The reasons for termination may include but are not limited to; –

  1. Any breach of the terms herein.
  2. Failure to make the necessary payments
  3. Failure to meet a set deadline for an activity.
  4. Illegal requests.
  5. Incompetence
  6. Dispute Resolution.

In case of any dispute during the performance and the interpretation of this Contract, parties agree to resolve the matter through mediation. Parties hereby consent to the jurisdiction and the laws of Ontario. 

  1. Governing Law.

The provisions of this Contract shall be governed and interpreted in accordance with the Ontario and Canadian laws.

  1. Severability.

Suppose a provision or term in this Contract is declared invalid or unenforceable by a court of law. In that case, the same shall be severed from this Contract, and the remaining provision shall continue to be in effect and binding upon the parties.

  1. Assignment.

The parties shall not assign the duties and responsibilities under this Contract to any third parties.

  1. Entire Agreement.

The terms of this Contract reflect the complete agreement between the parties herein and supersedes any prior oral or written negotiations or promises.
