EMPLOYMENT AGREEMENT.

This Employment Agreement (hereinafter referred to as the “Agreement”) is made and entered on this ____ day of _____ _______ (the “Effective Date”), between ______________, Contact Info: _____________________________, (hereinafter referred to as the “Business”), and _____________, Address ____________ (herein referred to as the “Employee”).

NOW THEREOF, in consideration of the mutual covenants and promises made by the Parties hereto, the Parties covenant and agree as follows:

  • TERM.

The initial term of this Agreement shall be for a period ________ [Weeks/Months/Years] commencing on the Effective Date herein, subject to being renewed for a ________ Year Term.

  • SCOPE.
    1. Job Title– the Business is hiring the Employee as a barber for the Barbershop known as _____________, located at ______________ Massachusetts. The Employee’s obligations shall include;

  1. Hours-the Employee shall work ___ hours weekly, subject to management policy in force from time to time, and the nature of the Business’s work policy, the Employee may be required to work on statutory public holidays or late into the night.
  • PAYMENT.

The Business shall pay the Employee _________________ Dollars for the services provided under this Agreement, payment shall be made Weekly   Bi-monthly    Monthly 

  • TERMINATION/CANCELLATION.
    1. Either party has the right to voluntarily terminate this appointment, provided the other party has given One (1) Day notice or in lieu of notice, the equivalent compensation for hours of work done by the Employee. Upon termination of the employment, the Employee shall return any items belonging to the Business in their custody, in good condition, on or before leaving the service of the Business.
    2. Please note however that the Business reserves the right to summarily dismiss the Employee in the event that:
  • There is inability to perform satisfactorily the duties assigned. 
  • Involvement in criminal acts.
  • Negligence of duty, insubordination, willful disregard of instructions, drunkenness and use of illicit drug, willful damage to property or any act that will bring the Business into disrepute.
  • Being absent from work for ______ consecutive working days without prior written approval.
  • NON-SOLICITATION/NON-COMPETE.
      1. The Employee understands that any communication with the Business’s customers shall only be through the Business. The Employee shall not, directly or indirectly, call, contact or communicate with the customers without prior notice with the Business notice.
      2. The Employee shall not, during the term of this Agreement and/or upon the termination/cancellation thereof, solicit, negotiate, and contact directly or indirectly, any other Business’s customers with the aim of conducting business with them. This includes not having a similar business on the side that they operate while still in employment with the Business as covered under this Agreement.
      3. The Employee shall not, during the term of this Agreement and/or Six Months after the termination/cancellation of the Agreement, by incitement encourage the Business’s customers, associates and/or employees to terminate their obligations with the Business.
      4. The Employee shall not, upon the termination of the Agreement, start a similar business within a 2 mile radius as the Business.
  • GENERAL PROVISION, GOVERNING LAW AND JURISDICTION.
    1. This Agreement contains the entire Agreement between the Parties relating to the subject matter hereof and supersedes any and all prior agreements or understandings, written or oral, between the parties related to the subject matter hereof.  No modification of this Agreement shall be valid unless made in writing and signed by both parties hereto.
    2. This Agreement shall be governed by and construed in accordance with the laws of the State of Massachusetts, USA. Exclusive jurisdiction and venue shall be in Massachusetts, USA.
    3. This Agreement shall be binding upon and inure to the benefit of the Business and the Employee and their respective successors and assigns, provided that the Employee may not assign any of their obligations under this Agreement without the Business’s prior written consent.
