RE: TRESPASS, DAMAGE OF PROPERTY AND ASSAULT CLAIM OF (the INJURED PARTY)
I am writing to you to resolve a trespass to property, property damage, and assault without protracted litigation. This claim is against Mr. Zied Retbi.
On —————————-, Mr. Zied Retbi entered gained unwarranted entry into my house where I was lounging with my girlfriend. Mr. Zied Retbi instigated a fight with me, accompanied by verbal abuse. The verbal abuse caused my girlfriend to be in shock. When I asked Mr. Zied Retbi to leave his property, he caused damage to my property and was reluctant to leave the premises when he was asked to do so. Later that day, Mr. Zied Retbi returned with his two brothers and attacked me in the middle of the night.
I will attach the ambulance deposition, which is detailed on the shock experienced by my girlfriend and the police intervention for proof of the said damage. Further, I have 21 days of convalescence with a broken bone, and I cannot perform my daily activities, including going to work.
Mr. Zied Retbi is required to settle these claims with a sum of 2092 Euros that should be paid before my second hospital visit, which is scheduled for 14th January 2021. Additionally, Mr. Zied Retbi and his brother will be required to sign a document that requires them to keep distance from the injured party. We will file a suit against you if you fail to settle these claims. This lawsuit will be based on the following causes of action: (1) Trespass into property, (2) Assault (3) Damage of property.
This letter serves as a pre-litigation courtesy in an attempt to resolve the claim outside of a court of law. Suppose this matter is not resolved by the time specified above. We reserve the right to commence legal proceedings to recover the amount from you, and this letter may be tendered in court as evidence of your failure to pay. Legal action may result in you having to pay legal costs, interest, and impact your criminal history negatively.
