Re: DEMAND LETTER.
To whom it may concern,
I am an Amazon seller. I invented and own a product, which is a lock with an ornamental
design. I duly made an application to the XXX Patent and Trademark Office on or
about July XXX. The application number is XXX
Consequently, on or about June XXX, my product’s design was patented for a term of
fifteen (15) years. The patent number is XXX
However, it came to my realization that another seller’s product infringes on my patented
product. Notably, XXX, bear notable similarities with my
design patent.
The material on my lock is made of crystal. Accordingly, to prevent light reflection, my
designer added auxiliary lines to the crystal part of the lock. The other seller’s product, XXX, materially copies the crystal part of my lock. This shows that the said
product(s) infringes on my design patent.
In light of the foregoing, I made several requests to you to have the other infringing products
removed since they violate my patent rights. Unfortunately, you have failed to consider my
request and have continuously allowed the infringing party to continue their listing and/or
sales while using my patented design.
Please note that my company has suffered immensely from Covid-19. Besides, the infringing
party has also taken my orders, thus leaving my company with little profit. It is totally unjust
for the infringing party to continue benefitting economically from an infringement of my
patented design.
Accordingly, please note that your removal of the infringing party’s products would not only
protect my property rights from infringement, but would also be in the interest of justice.
I therefore demand that you remove the infringing products listed under XXX until they alter their design.
If you don’t comply our demand, we will have no choice but to take legal actions against you
for negligence, infringement on our Patent, and failure to abide by legal policy. This option
will seriously impact your reputation.
