Pursuant to the Safety Recall Notice dated September 2020 and any other document relevant to the subject matter herein (attached to this letter), the purpose of this letter is to notify you regarding a breach of terms and misrepresentation of information.
On the 4th day of March 2018, I brought my car, (Car Description: 2014 Lincoln MKZ VIN Number: 3LN6L2GK3ER828129) over to Cal Worthington Ford to check Engine light which was defective. However, the engine light was only switched off but the actual problem was not fixed. The lights came on again and I took the car to Pete’s Auto Repair in Bellflower, California for a second checkup and was told that the catalytic converter was defective. On the 8th day of July 2020, I brought the car to Ford Reeves Lincoln to have the engine light checked and further informed them about the defective catalytic converter. However, I was told that the catalytic converter is not defective. Further, on the 23rd of July 2020, I took the car to Downey car-care Center in California to have the engine light checked. They confirmed that the Catalytic converter was defective and it needed to be replaced. I was charged a total of $ 2,277.12.
The duty to repair and replace faulty parts is delegated to the Ford Motor Company. However, after notifying your personnel regarding the faulty catalytic converter, no action was taken. Further, Ford personnel misrepresented facts about the faulty parts by claiming that the catalytic converter was not faulty. I had to replace the catalytic converter at my expense which should not be the case.
I spend a total of $ 2,277.12 on the repairs which I formally ask to be reimbursed.
For this reason, I hold you responsible for proceeding in acts that have directly violated terms of the agreement between us. Unless the aforementioned issue is resolved, this letter formally places you on notice of the legal requirements concerning document retention and expects you and all your affiliates to honor such requirements.
You have a legal obligation to maintain and preserve any and all documents, materials, and information, in any form whatsoever, which may be potentially relevant to the subject matter, or discoverable in any potential action arising from this breach.
It is in the best interest of both parties to resolve this matter as soon as possible. If there is no response by ___________________, 20____, then it shall be my right to pursue any and all available legal and equitable remedies, including, but not limited to, instituting formal litigation proceedings against you in accordance with the laws of California.
The receipts and any document relevant to the subject matter have been attached to this letter for formality and reference purposes.
