RE: DEMAND FOR REFUND
On [Insert Date], I booked a yacht from your company for a tour and paid the required
amount of $_________. On [Insert Date], the day of the tour, the yacht that you advertised and I
paid for was not available. I was informed that it was under maintenance, hence it could not be
used on that day. Another boat was provided which I had not paid for.
Your advertising of yachts for boat tours led me to believe that I would be getting a yacht
experience. I would like to believe that it is true that the yacht was under maintenance, that’s
why you availed the other boat. In that regard, it would only be fair for you to refund an amount
of $__________ because you did not provide me with the yacht experience you advertised and I
paid for. Otherwise, that is false advertising, fraud, intentional misrepresentation and unjust
enrichment on your part.
I hereby demand that you issue me with a refund in the sum of $____________. I will
pursue any legal and equitable remedies available to me if you fail to issue me with the above
refund. These remedies include but are not limited to, suing you civilly for damages.
Again, you must issue me with the above refund within 7 days from the date of this letter.
I expect you to send me written confirmation that you will issue me with the refund within the
indicated timeline. You risk incurring legal consequences if you fail to comply with this demand.
This letter will act as my final warning to issue me with a refund before I pursue legal
action. At this time, I am not filing a civil suit against your company, as I hope we can resolve
this matter without authoritative involvement. I am not under any circumstances, however,
waiving any legal rights I have presently, or future remedies against your company by sending
this letter. Thank you for taking your time to read this letter.
