CHILD ACTOR RELEASE AGREEMENT

BETWEEN
- XXX, LLC (“XXX, LLC”), a limited liability company registered under the laws of [Jurisdiction], with its principal place of business at [Address], referred to as the (“Producer,”)
AND
2.[Child’s Name], with an address at [Insert Address] hereinafter referred as the (“Child”)
RECITALS
WHEREAS, the Child has been selected to perform as an actor in the film titled “[PRODUCTION TITLE]” (the “Film”), directed by [Director’s Name] and produced by XXX, LLC;
WHEREAS, the Child and their legal guardian acknowledge that the Child’s participation in the Film will be subject to the terms and conditions set forth in this Agreement;
NOW, THEREFORE, in consideration of the mutual covenants contained herein, and for other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the parties hereto agree as follows:
- GRANT OF RIGHTS:
3.1 The Child and their legal guardian hereby acknowledge and agree that XXX, LLC shall be the sole and exclusive owner of all rights, including but not limited to copyright rights, in and to the Child’s performance, image, voice, and likeness captured in any recordings/photography (the “Recordings”) related to the Film, for all purposes and perpetuity. The Child and their legal guardian assign any copyright rights, publicity rights, or any other rights they may have in the Recordings toXXX, LLC.
- COMPENSATION:
4.1 In consideration for the Child’s participation in the Film, XXX, LLC agrees to compensate the Child the sum of $800. This compensation shall be paid to the Child within 30 days following the official release of the Film.
- RELEASE AND WAIVER:
5.1 The Child and their legal guardian hereby release and discharge XXX, LLC and its representatives from any and all claims, liabilities, demands, actions, causes of action, costs, and expenses of any nature whatsoever arising out of or in connection with the Child’s participation in the Film and the use of the Recordings, including, but not limited to, any claims for defamation, invasion of privacy, or infringement of any right of publicity.
- TERMINATION:
6.1 Termination by Producer: The Producer reserves the right to terminate this Agreement, and the Child’s participation in the Film, for the following reasons:
6.1.1Tardiness: In the event that the Child consistently arrives late for scheduled performances or rehearsals without valid justification.
6.1.2 Moral Issues: If the Child engages in conduct that is deemed immoral, illegal, or in violation of the standards of behavior expected from a professional actor, as determined by the Producer.
6.1.3 Hostile Behavior: If the Child engages in behavior that creates a hostile, disruptive, or unsafe environment for other cast and crew members.
6.2 Compensation Upon Termination: In the event of termination, the Child shall not be entitled to any further compensation or remuneration beyond the date of termination, and any unpaid compensation up to the date of termination shall be forfeited.
6.3 Notice of Termination: The Producer shall provide written notice to the Child’s legal guardian of the intent to terminate this Agreement, specifying the reasons for termination. The termination shall be effective immediately upon the receipt of such notice.
- ACKNOWLEDGMENT:
7.1 By signing this Agreement, the Child’s legal guardian acknowledges that they have carefully read and understand the terms and conditions contained herein, and they consent to the Child’s participation in the Film and the use of the Recordings as set forth in this Agreement.
- DISPUTE RESOLUTION:
8.1 In the event of any dispute arising out of or relating to this Agreement, the Parties agree to first attempt to resolve the matter amicably through mediation. If mediation does not result in a resolution, the dispute shall be settled through binding arbitration in accordance with the rules of the American Arbitration Association. The costs of mediation and/or arbitration shall be borne by the party initiating the dispute.
- GOVERNING LAW:
9.1 This Agreement shall be governed by and construed in accordance with the laws of [Jurisdiction], without regard to its conflict of laws principles.
- AMENDMENT AND WAIVER:
10.1 Any amendment or modification to this Agreement shall be valid only if executed in writing and duly signed by both parties. The waiver of any breach or default under this Agreement shall not constitute a waiver of any subsequent breach or default.
IN WHITNESS WHEREOF, the parties hereto have executed this Child actor Release Agreement as of the date first above written.
