I refer to Complaint ID. 8344218861.
I partnered with Amazon Fulfillment centres to sell my Trü Fizz products this year in February 2021. On or about May 10th, 2021, I registered with Amazon Brand Registry. My brand was accepted after presenting my registered trademark documents. My brand is duly registered at the USPTO under the Trade Name Trü Fizz, No. 5687124.
Shortly after, I noticed a brand going by several names (True brand and Hour loop), ASIN B07HBN7MBL. The company was selling their champagne stoppers under the name “True Fizz”, which is the legal pronunciation of my registered trademark. Accordingly, I submitted several complaints to you, and you assured me that the listing was removed and or altered by your team multiple times. However, I was able to purchase the company’s item and their packaging does display my trademark.
I also engaged Lucy Shih, the Executive Director of Hour Loop, who sent me a very concerning email, stating that she knows that “True Fizz” is my trademark and refused to abide because we do not sell the same products. She also asked me to retract my complain to Amazon. Such conduct amounts to a total disregard and violation of my Intellectual Property rights.
Unfortunately, you have failed to protect my brand and have continuously allowed Hour loop to continue their listing and/or sales while using my trademark.
I kindly request that you remove Hour Loop’s products listed under ASIN B07HBN7MBL until they alter their packaging and listing name.
If you don’t comply our demand, we will have no choice but to take legal actions against you for negligence, Infringement on our Trademark, and failure to abide by legal policy. This option will seriously impact your reputation.
