CAR RENTAL AGREEMENT
This Rental Agreement is entered into on _____________________between
______________________ (hereinafter referred to as the “owner”) and
____________________ (hereinafter referred to as the “Renter”). Together referred
to as “parties”.
The owner hereby rents out to the renter, and the renter hereby rents from the owner
a vehicle under the following terms and conditions: –
1. Description of the Vehicle.
The vehicle to be rented is identified by the following: –
2017 Chevy Civic
Silver
Black/Gray cloth
Some stains on the front seats and the formats in the front.
A couple of scratches on the rear bumper and front bumper.
A dent on the rear passenger door.
No child seats.
2. Rental Period.
The vehicle will be rented out to the renter from __________ until ____________.
Parties agree that eventually, the subject vehicle herein will be sold.
3. Ownership of Vehicle.
The owner retains the vehicle’s title at all times. The renter must not agree, attempt,
offer, or purport to sell, assign, pledge, lease, or otherwise part with or attempt to
part with possession or otherwise deal with the vehicle.
4. Payment.
Parties agree that the renter shall pay the owner _____ every month.
5. Damage, Destruction, or Loss of Vehicle.
Suppose, during the term of this rental and until the return of the vehicle, it is
damaged, destroyed, stolen, abandoned, or taken by any judicial or governmental
authority. In that case, the renter will remain financially responsible and shall notify
the owner within ten days of any of these events.
6. Use of Vehicle.
The customer agrees that they will use the property for lawful purposes only during
the term of this rental.
7. Maintenance & Repairs.
The renter agrees to maintain the property in good working condition and not misuse
or abuse it.
The renter agrees not to allow pets in the subject vehicle.
8. Insurance.
The parties agree that there will always be a valid insurance cover for the vehicle
when used by the renter.
9. Indemnity.
The owner shall not or under any circumstances be liable for any damage or injuries
to persons or property suffered or sustained in the vehicle’s use, condition, or
operation and all such claims that the renter waives explicitly.
The renter agrees to and does hereby hold the owner free and harmless from any
losses, costs, demands, or liability whatsoever, including legal costs and attorney’s
fees.
10. Governing Law.
This Agreement shall be governed by and construed in accordance with the laws of
_____________.
11. Dispute Resolution.
In the event of a dispute between the parties, the same shall be negotiated between
the parties, and if it fails, the parties shall refer the dispute to mediation.
12. Waiver.
No waiver by either party of any default shall be deemed a waiver of prior or
subsequent default of the same of other provisions of this Agreement.
13. Severability.
Suppose a court of competent jurisdiction holds any term, clause, or provision hereof
is invalid or unenforceable. In that case, such invalidity shall not affect the validity or
operation of any other term, clause, or condition, and such invalid term, clause, or
provision shall be deemed severed from the Agreement.
14. Entire Agreement.
This Rental Agreement constitutes the parties’ entire agreement concerning the
subject matter of the agreement. It supersedes and cancels any previous
representations, agreements, understandings, or arrangements (whether written or
oral) between the parties.
By signing below, the parties hereby agree to be bound by the terms of this
agreement with one another.
