CAR RENTAL AGREEMENT.
THIS AGREEMENT is hereby entered into on this ………………day of …….……………. Two Thousand and ……………………………
BETWEEN
1.XXXX, the owners of XXX, a car rental company with its principal place of business at ZZZ . Hereinafter referred to as “XXX”
AND
- XXXX the owners of the cars. Hereinafter referred to as “the Owners” collectively referred to as “the Parties”
WHEREAS, the Owners own four vehicles, which they are renting out through XXX; and
WHEREAS, the Parties wish to set forth the terms and conditions under which the Owners will rent their vehicles to XXX.
NOW, THEREFORE, the Parties agree as follows:
3.RENTAL OF VEHICLES:
The Owners hereby agree to bring their vehicles to XXX to be rented out to customers “the Renters”, XXX will be liable for sending out the cars and any damage that may occur during the rental period.
4.LIABILITY FOR DAMAGE:
If there is damage to the vehicle during the rental period without the Renters insurance, liability shall fall under XXX . They shall be responsible for covering any damages through insurance or by paying for them.
5.INSURANCE VERIFICATION:
Ace Exotics shall verify insurance before each rental period. If XXX does not follow through with insurance verification and there is an accident and the insurance is fake or not verified, XXX shall be responsible.
5.RESPONSIBILITY FOR FINES:
XXX, XXX, XXX, and XXX are not taking responsibility for any EZ Pass fines, speed camera or parking tickets. The Renter must be billed. If the Renter does not comply, we will be taking it from the Renter’s deposit.
6.PROOF OF EXPENSES:
All expenses must come with proof of invoice. Either party must bring invoices from gas to monthly payment to insurance to any time the car is in the shop.
7.TERM AND TERMINATION:
This Agreement shall remain in effect for a period of [insert number of years] from the Effective Date, unless earlier terminated by mutual written agreement of the Parties or upon the expiration of the term.
8.DISPUTE RESOLUTION:
In a case that the Parties cannot amicably resolve a dispute from this Agreement, the parties agree to resolve any such dispute or damage claim by mediation. The mediation proceeding shall be conducted in New York, in accordance with the rules of the American Arbitration Association then in effect with one (1) Mediator to be selected by mutual agreement of the Parties.
9.GOVERNING LAW:
This Agreement shall be governed by and construed in accordance with the laws of the state of New York.
10.ENTIRE AGREEMENT:
This Agreement constitutes the entire agreement between the Parties and supersedes all prior agreements and understandings, whether written or oral, relating to the subject matter of this Agreement.
