CAR RENTAL AGREEMENT
This Lease is entered into on _____________________between, XXX Property
Management Company, herein after referred to as “the company” and
hereinafter referred to as “the customer”.
The company hereby rents out to the customer, and the customer hereby rents from
the company a vehicle under the following terms and conditions: –
1. Description of the Vehicle.
The vehicle to be rented is identified by the following: –

2. Rental Period.
The vehicle will be rented out to the customer on a ________ rental basis until this
agreement is terminated.
3. Ownership of Vehicle.
The owner retains the vehicle’s title at all times. The customer must not agree,
attempt, offer, or purport to sell, assign, pledge, lease, or otherwise part with or
attempt to part with possession or otherwise deal with the vehicle.
4. Payment.
The customer shall pay the company a refundable deposit of $250.
The agreed fee per _________ during the rental period is _______.
5. Damage, Destruction, or Loss of Vehicle.
Suppose, during the term of this Lease and until the return of the vehicle, it is
damaged, destroyed, stolen, abandoned, or taken by any judicial or governmental
authority. In that case, the customer will remain financially responsible and shall
notify the Company within ten days of any of these events.
6. Use of Vehicle.
The customer agrees that they will use the property for lawful purposes only during
the term of this rental. The property shall not leave the United States without the
Company’s written permission.
7. Maintenance & Repairs.
The customer agrees to maintain the property in good working condition and not
misuse or abuse it.
8. Insurance.
The parties agree that there will always be a valid insurance cover for the vehicle
when used by the customer.
9. Indemnity.
The Company shall not or under any circumstances be liable for any damage or
injuries to persons or property suffered or sustained in the vehicle’s use, condition, or
operation and all such claims that the customer waives explicitly.
The customer agrees to and does hereby hold the Company, its agents, and
employees free and harmless from any losses, costs, demands, or liability
whatsoever, including legal costs and attorney’s fees.
10. Termination.
Either party may terminate the rental agreement by giving the other prior notice.
The Company shall have the right to terminate this agreement and take possession
of the vehicle when there are any payment delays.
11. Governing Law.
This Agreement shall be governed by and construed in accordance with the laws of
the state of Texas.
12. Dispute Resolution.
In the event of a dispute between the parties, the same shall be negotiated between
the parties, and if it fails, parties shall refer the dispute to mediation.
13. Waiver.
No waiver by either party of any default shall be deemed a waiver of prior or
subsequent default of the same of other provisions of this Agreement.
14. Severability.
Suppose a court of competent jurisdiction holds any term, clause, or provision hereof
is invalid or unenforceable. In that case, such invalidity shall not affect the validity or
operation of any other term, clause, or condition, and such invalid term, clause, or
provision shall be deemed severed from the Agreement.
15. Entire Agreement.
This Rental agreement constitutes the parties’ entire agreement concerning the
subject matter of the agreement. It supersedes and cancels any previous
representations, agreements, understandings, or arrangements (whether written or
oral) between the parties.
By signing below, the parties hereby agree to be bound by the terms of this
agreement with one another.
