Re: NOTICE OF RESCISSION
We entered into a Retail Installment Sale Contract for the purchase of a 2013 Ford Truck Explorer, identification no. 1FM5K8D86DGC38443. I was to make 63 monthly payments of $330.87 each beginning 01/18/2022. The contract is hereby attached.
I would like to express my intent to rescind the above transaction and hereby issue this notice of rescission pursuant to 15 U.S. Code § 1635. The reason for rescission is your failure to inform me of my right to rescind the above transaction.
12 CFR § 1026.23(b) places a duty on creditors to deliver two copies of the notice of the right to rescind to each consumer entitled to rescind. The notice of the right to rescind must disclose the retention or acquisition of a security interest in the consumer’s principal dwelling, the consumer’s right to rescind the transaction, how to exercise the right to rescind, the effects of rescission and the date the rescission period expires. You (the creditor) failed to avail to me a notice of the right to rescind containing the above. I am hereby exercising my right to rescind in accordance with the foregoing provisions of federal law.
You have twenty (20) days after the receipt of this letter to return to me all monies I have paid in the transaction and to take any action necessary to reflect the termination of any security interest created under the transaction. Please be advised that if you do not cancel the security interest and return all consideration paid within 20 days of receipt of this letter, you will be responsible for actual and statutory damages pursuant to 15 U.S.C. § 1640(a).
