I hope this letter finds you well

I am writing to you regarding an issue between us “Omar and John” and ABCDA group referee to them as “ABC”. We have purchased 2 apartments units as a Real Estate Investment in Sulanate of Oman in order to receive Residency Permits.

Details and events are listed below in order:

  1. October 01, 2018, we have entered on a purchase agreement with ABC for the purchase of the unit no. M-1-1111 at Forest Project. Check the attached contract. The property was under development. Handover at completion was scheduled 24 months of signing the contract. As part of the investments system on Sultanate of Oman, we shall receive residency permit based on this investment.
  2. June 06, 2019, due to our need to the residency permit sooner, we have decided to purchase another property with the same resort, but on another section called Hawan. Unit number is (M-2-1111). The unit was ready for handover in order for us to apply for the Residency Permit. The unit was owned by another clients of ABC, but the purchase was through them. 75% of the purchase amount was paid in order to start the process by filing the security clearance and approval. This process usually takes between 3 and 6 months.
  3. November 12, 2019, we have been told by ABC that the Security Clearance was filed incorrectly using the name of the previous owner of the unit, instead of us. Due to this mistake, 6 months of wait was wasted. 
  4. July 15, 2020 we were informed that the security clearance and approval was granted. However, it was too late due to Oman closure in front of any travelers due to corona Pandemic. 
  5. On August of 2020, in the middle of the Pandemic, ABC sent us an acknowledgement to sign and to receive the unit based on pictures and videos only, and asking for the last payment. We have responded that due to the Pandemic and the current circumstances we won’t be able to make the payments on time, but we are still committed to our obligation toward them. However, our request was unthoughtfully denied, so we were forced to make extra arrangements to make the payment. Furthermore, we didn’t acknowledge the completion of the handover of the unit.
  6. On May 18 of 2021, ABC sent us the attached notice confirming the legal handover of the unit and denying their responsibilities of any damages that may occur to the unit due to the so-called delay from our side.

Therefore, we are requesting from you to assist us to clearly state and request the followings:

First of all, we have been extremely affected by their mistake of submitting the wrong information for the security clearance. We are holding them accountable and responsible for this mistake which we are still severing from it until now. Due to the mistake, the security clearance took 11 months instead of 3, which defeated the whole purpose of the second purchase. If they haven’t done so, we’d have been able to enter the country, get the residency, and take advantage of our investment.

Second, due to the Pandemic that affected the whole world, regulations in Oman continues to remain boarders closed until this moment in front of all non-citizens and non-residences of Oman, especially Yemenis. Due to those regulations we are unable to enter the country and complete the Handover of the unit.

Finally, we don’t accept any responsibilities of the unit and we are denying the handover. In fact, we are holding them accountable and fully responsible for any damages that may occur and for the handover delay. We also are requesting a compensation for the harm caused by their careless administrative mistake that caused those issues and extremely affected us and our business.
