KNOW ALL MEN BY THESE PRESENTS: THAT, DAVID HILL and spouse,
RYAN HILL, whose mailing address is 1007 Daphne Court, Austin, Texas 78704,
hereinafter collectively called "Grantor," for and in consideration of the sum of TEN AND
NO/100 DOLLARS ($10.00) and other good and valuable cash consideration to the
undersigned in hand paid, the receipt and sufficiency of which is hereby acknowledged,
and for which no lien, either express or implied, is herein retained, has GRANTED,
SOLD, and CONVEYED, and by these presents does GRANT, SELL, and CONVEY,
subject to the exceptions set out below, unto HCCTX RENTALS AND MANAGEMENT,
LLC, a Texas limited liability company, acting by and through its duly authorized
Managing Member, DAVID HILL, with its principal place of business in the County of
Grimes, State of Texas, and its mailing address being 6984 County Road 344,
Navasota, TX 77868, hereinafter called "Grantee," all that certainparticular tract or
parcel of land which is owned by Grantor lying and being situated in Grimes County,
Texas, more fully described as follows, to-wit:
Being a 17.83 acre17.83-acre tract of land, more or less, situated in the JOEL
GREENWOOD SURVEY, A-20 in Grimes County, Texas, and being described
by metes and bounds on EXHIBIT "A",," attached hereto and made a part
hereof;
TOGETHER WITH all rights, privileges, and appurtenances pertaining thereto,
including but not limited to: water rights, claims, permits, strips and gores,
easements, and cooperative or association memberships (hereinafter collectively
called the “Property’).
THIS CONVEYANCE IS EXPRESSLY MADE AND ACCEPTED SUBJECT TO
THE FOLLOWING, TO-WIT:
1. All leases, grants, exceptions, or reservations of coal, lignite, oil, gas, and other
minerals, together with all rights, privileges, and immunities relating thereto, if
any, relating to the Property shown of record in the Office of the County Clerk of
Grimes County, Texas.
2. Visible and apparent easements and encroachments or protrusions of
improvements affecting the property.
3. Mineral Reservation as set out in the Deed dated June 8, 1983, executed by
Mitchell Development Corporation of the Southwest to vera Hudson, recorded in
Volume 479, Page 184, Real Property Records of Grimes County, Texas.
4. Easement dated August 22, 1978, executed by Mitchell Development
Corporation of the Southwest to Gulf States Utilities Company recorded in
Volume 365, Page 71, Deed Records of Grimes County, Texas.
5. Timber Deed dated June 24, 1994, executed by Toledo P. Boulware to
Champion International Corporation, recorded in Volume 746, Page 690, Real
Property Records of Grimes County, Texas.
6. Easement as set forth in instrument dated April 24, 1962, executed by Grogan
Cochran Lumber Company to Houston Lighting and Power Company recorded in
Volume 252, Page 198, Deed Records of Grimes County, Texas.
7. PortionA portion of the Property property lying lies within the boundaries of Co.
Road 344.
The exceptions listed above are solely for the purpose of qualifying the estate
conveyed herein and the Grantor’s warranty of title, and no reference or recital herein
shall create, enlarge, extend, ratify, confirm, or be the basis for any right, title, estate,
claim, or demand in favor of any party other than the Grantor and Grantee, their
respective heirs, legal representatives, successors, and assigns.
TO HAVE AND TO HOLD the above describedabove-described Property,
subject to the exceptions set forth above, together with all and singular the rights and
appurtenances thereto in anywise belonging unto the said Grantee, Grantee’s heirs,
successors, and assigns forever; and Grantor does hereby bind Grantor, Grantor’s
beneficiaries, heirs, executors, and administrators, to WARRANT AND FOREVER
DEFEND all and singular, the said premises unto the said Grantee, Grantee’s heirs,
successors, and assigns, against every person whomsoever lawfully claiming, or to
claim the same, or any part thereof, subject however to the exceptions set forth
hereinabove.
CURRENT AD VALOREM TAXES having been prorated and paid to the date
hereof, Grantee expressly assumes the payment of all future ad valorem taxes
