My name is Malay Parekh and I have been working at __________________for 18 years. However, recently my services were terminated unfairly and while working for the organization, I had been subjected to discrimination by my supervisor and other people.  Despite complaining to the supervisor, Ian Temple about the discrimination on the basis that I am Indian, the supervisor dismissed my complaint stating that everyone is different. The said discrimination has led to me experiencing health issues, and emotional and mental anguish.

I would like to cite some incidences where my supervisor has treated me differently. In 2020, my previous supervisor, Trisha Poer allowed female employees to work from home yet I was not allowed to work from home. Secondly, other employees were allowed to report to work late whilst I was not given such an allowance. When I came into close contact with a person I was allowed two weeks off, however, my supervisor called me back to work after 11 days without a covid teast whereas another employee was allowed two weeks and two days quarantine period. Additionally, two of my fellow employees shift was changed under “Covid” period yet I was not considered for the same.

In one instance I complained about defective media being used in crystals sample processing, I was almost eliminated from performing crystals testing while those who did not complain were retained. Further, I was also discriminated against when I complained about the enclosed lab which I worked in, the lab was backed up with a sewer, which emitted bad odor. Ian Temple, my supervisor stated that other analysts had not complained yet they had complaining stating that the bad smell caused them headaches.

Further in March 2021, Ian Temple, my supervisor, scheduled everyone for the new ROBOT system for Endotoxin testing except me. This is despite my Senior specialist position and despite my 18 years’ experience in the Company. Also, Ian Temple would always schedule me for A and B methods which are least preferred and assign other employees Endotoxin tests and Crystals testings. In 2019, I complained to Trisha Poer about pain in my shoulders when I run heavy load B method samples but she refused to consider my plight and instead loudly stated that I should get the doctor’s note.

My employment was unfairly terminated because I made a minor mistake made on a sample receipt. In a 26 April 2021 meeting with Human Resource, is explained that the mistake was as a result of a lot of stress that I was undergoing during that time. The HR did not listen to me, neither was he empathetic and considerate of natural stresses that might have been caused by the vaccine I received on 16th April 2021, I made the mistake on 19th April 2021. Instead, the next day my employment was terminated without a probationary period accorded to other employees.

I would like my termination from the Company to be reviewed and the Company ordered to practice fair employment practices. Further, I would like to be awarded damages for the health conditions, emotional and mental anguish suffered as a result of discrimination and unfair termination.
