James Muscat – Founder and Principal Lawyer James George Muscat. James has a career of experience not only as a lawyer but also as a practising Pharmacist. 

His background in health brings a deep understanding of the mental health issues that are associated with experiencing a legal battle. This element also enables him to advocate on your behalf when it comes to health-related issues in any area where a dispute arises.

James is also a Certified Collaborative Lawyer and Registered, Migration Agent (MARN 1467452).

Family Law

Separation can be an extremely stressful time for everyone involved. It is often life changing, you may experience stress, fear, guilt, anxiety and anger and these emotions can have major effects on other aspects of your life such as social circles, your career and finances.  There are many different approaches available to you. We have non-litigious alternatives like collaborative law to avoid going to court.   • Divorce

In Australia parties to a marriage must be separated for at least 12months and the marriage must have irretrievably broken down with no chance of reconciliation. An application for divorce can be filed jointly or by one party separately. We have options to assist as little or as much as possible as well as DIY. You cannot legally marry again until you are divorced

Any parenting arrangements or division of property is dealt with separately to the divorce and is determined prior to making an application for Divorce.

  • Collaborative Law

Collaborative Law – Begins by both parties agreeing that they won’t go to court. It removes all the angry letters back and forth. The parties take responsibility for their actions and the resolution without resulting in court. Respectful and collaborative approach to meet the expectations and wishes of the parties and the best interests of their children and any jointly owned property. Discuss wishes in an open and respectful environment, fostering open communication and minimises any risk of misinterpretation. 

  • Parenting Plans

 

One way to formalise an agreement between spouses regarding the care of their children is through a Parenting Plan. There are many factors to be considered and therefore a carefully drafted and detailed plan will ensure there is no confusion. Our team is highly skilled when it comes to formalising an agreement and very experienced ensuring all possible bases are covered.

 

The parenting plan will outline by agreement all present and future arrangements of the children regarding all aspects of their life and care and sets out the way in which the plan can be altered or changed. It is important to note that parenting plans are not enforceable and therefore if you wish to obtain an enforceable agreement or if you and your spouse cannot agree then an application can be made to the court for parenting orders. 

  • Children/Consent Orders Etc

 

Parenting orders are orders made by the court that deal with the arrangements for children when parents have separated. Parenting orders can be made by agreement by the parties through ‘Consent Orders’ or determined by the court. It is very import to have an experienced Family Lawyer to guide you through the process and advocate on your behalf.

 

Where the children live, their schooling, holidays, ensuring meaningful relationships with various family members and how you will deal with changes are all relevant when it comes to sorting our arrangements for your children.

 

It is important that parties focus on what is in the best Interests of the child and successfully agree on arrangements made. 

 

A collaborative approach ensuring the children are focused on is best practice. Alternatively, mediation can be provided to assist in the process. As a last resort a court will make the decisions for them. A skilled Family Lawyer is important to bring reason during this process, especially for complicated matters.
