I hope this letter finds you well. I am writing to provide an update on the status of my involvement in the case referenced above and to clarify the actions I have taken in pursuit of a just resolution.

 

Initially, I was named as a third-party defendant in this case. However, I subsequently filed a motion to dismiss myself from the role of a third-party defendant, which was duly accepted by the Honorable Judge [Judge’s Last Name]. As a result of this motion, I have been formally dismissed from the role of a third-party defendant. It is important to emphasize that this motion solely pertained to my dismissal from the position of a third-party defendant.

 

I wish to clarify my ongoing position within this litigation. While I have been relieved of my role as a third-party defendant, I remain a third-party plaintiff seeking to uphold my rights and pursue justice in this matter. Despite the dismissal of my third-party defendant status, I continue to assert my claim as a third-party plaintiff against the Defendants, ANTHONY PRESKY and PRIDE GENERAL CONTRACTING & ENVIRONMENTAL SERVICES, LLC.

 

I regret to inform the Court that my efforts to engage with opposing counsel have been met with significant challenges. Regrettably, the attorneys representing the Defendants have not responded to the original complaint I filed in this case, and they have exhibited a reluctance to engage in meaningful communication. This lack of response has hindered the progression of this case and has prevented me from moving forward in a timely manner.

 

Given the circumstances, I am resolute in my pursuit of final summary judgment, which I believe is warranted based on the merits of my claim and the evidence presented in the original complaint. The absence of response from opposing counsel underscores the validity of my position and the necessity of a fair and just resolution.

 

I kindly request the Court’s consideration of the challenges I have outlined and the support required to navigate these difficulties. My commitment to upholding the principles of fairness and justice in this matter remains steadfast, and I am confident that the Court’s guidance will contribute to a timely and equitable resolution.
