RE: TERMINATION OF THE “EXCLUSIVITY CLAUSE” IN OUR AGREEMENT.
With this letter, I hereby notify you that due to the violation of the Exclusivity Clause in our Agreement, you have loss the privileges that were covered under the aforementioned Clause. The Clause states “…Each calendar year during the Term of the Supply Agreement Customer shall purchase a quantity of Product no less than two (2) metric tons in 2018 and no less than four (4) metric tons in 2019 and throughout the Term of this Agreement. The exception is the remainder of 2017 where Customer expects to order 700 kg of the Product. These anticipated purchase volumes are based on current Sales forecast, which may go up or down in a given year. Exclusivity will not be revoked if the Annual Minimum Purchase Obligation of four (4) metric tons is within a 10% fluctuation, providing a lower limit of three-point six (3.6) metric tons…”.
Thank you for doing business with us this far and although there has been the termination of the Exclusivity Clause, we are glad to inform you that this does not affect the rest of our Agreement and hence we would love to retain you us our customer.
